1729.01 FOOD LICENSES; FEES.
   (a)   On or before March 1, every person, firm, association, or corporation engaged in conducting a food service operation, retail food establishment or vending machine location in the City shall procure a license from the Board of Health for each such operation so conducted or proposed to be conducted. No person, firm, association or corporation shall maintain and conduct a food service operation, a retail food establishment, or a vending machine location in the City without such license issued by the Board of Health.
   (b)   Any person, firm, association, or corporation who has received a license as required by subsection (a) hereof, on the sale or disposition of the food service operation or retail food establishment or the removal to new location, may, on obtaining the consent of the City Board of Health, have the license transferred, but no license shall be transferred without this consent, nor more than once.
   (c)   The Board of Health is empowered to establish the fee for the license and to enforce regulations under which the license is issued and permitted to remain in effect, as provided by Ohio R.C. Chapter 3717. An annual license fee shall be levied on each food service operation and retail food establishment in the City for the purpose of maintaining, enforcing, and paying the expenses of inspection of the food service operations and retail food establishments. The fee for a food service operation or retail food establishment license for each calendar year, or part thereof, shall be established by the Board of Health at a frequency not to exceed once per year.
   The Board of Health shall establish license fees based upon uniform cost methodology outlined in Ohio Revised Administrative Code, Chapter 3701-21 and Ohio R.C. Chapter 3717.
      (1)   The license fee shall be based upon the risk factors determined in Ohio Administrative Code, Chapter 3701. A list of current license fees may be obtained from the Health Commissioner or Director of Environmental Health.
      (2)   The operator of vending machines shall obtain a license for each vending machine location (defined in Ohio R.C. 3717.01(L)). The license fee for the vending machine location shall be established by the Board of Health at a frequency not to exceed once per year. The Board of Health shall set license fees based upon the uniform cost methodology outlined in Ohio R.C. 3717.07 and Ohio Administrative Code 3701-21.02-2.
      (3)   The operator of a temporary food stand, food service operation, or retail food establishment shall obtain a license from the Board of Health. The license fee for temporary food standard shall be established by the Board of Health at a frequency not to exceed once per year. The Board of Health shall set license fees based upon the uniform cost methodology outlined in Ohio R.C. 3717.07 and Ohio Administrative Code 3701-21.02-2.
   (d)   The Board of Health shall collect the state fee for each food license issued. The Board of Health shall transmit the state fee to the Ohio Director of Health or Ohio Director of Agriculture as required by Ohio Administrative Code 3701-21-02.
