705.01 DEFINITIONS.
    As used in this chapter, the following terms shall have the meanings respectively ascribed to them:
   (a)   "Mechanical amusement device" means a device including a machine or video device which, upon the insertion of a coin, token, dollar, credit or debit card or any other form of currency or thing of value, operates or may be operated, for use as a game, contest, or amusement of any description. This definition does not include any mechanical or electrically operated amusement device which is a gambling device as defined by the Statutes or regulations of the State of Ohio or the Ordinances or regulations of the City of Coshocton, and does not include merchandise, food, or beverage vending machines nor jukeboxes.
   (b)   "Owner" means any person, entity, firm or corporation owning and having title to any such mechanical amusement device, or any person, entity, firm or corporation having the right to control the use of such mechanical amusement device pursuant to a lease, license, rental, or other agreement.
   (c)   "Exhibitor" means any person, entity, firm or corporation permitting any mechanical amusement device to be installed, used, or exhibited in his or its own place of business.
   (d)   "Independent Testing Laboratory" means a laboratory with an established business operation within the State of Ohio which is neither owned or operated by the State of Ohio, any of its political subdivisions, or any owner, operator, manufacturer, supplier or provider of skill-based amusement devices; which possesses the knowledge or training sufficient to enable them to provide a report as to whether or not the device in question complies with the Statutes of the State of Ohio and the Ordinances of the City of Coshocton, regarding or pertaining to gambling.
   (e)   "Qualified Expert" means a person who has been qualified as an expert by the State of Ohio, to provide a report as to whether or not the device in question complies with the Statutes of the State of Ohio and the Ordinances of the City of Coshocton, regarding or pertaining to gambling; or has been qualified as an expert witness in said field by any Court in the State of Ohio.
