1333.06 NUISANCE ABATEMENT; ASSESSMENTS OF COSTS.
   (a)    The City of Coshocton shall have the power to abate and remove all nuisance within the City and assess the costs and expenses of abatements on the property where the nuisance is situated. This assessment, when duly certified by the President of the Board of the County Auditor, shall become a lien, to be collected in the same manner as any other tax in favor of the City. The City of Coshocton shall also have the power to compel the proprietor, owner, agent, assignee, occupant or tenant of the lot, property, house or building on or in which any nuisance may be made, to abate and remove the nuisance.
   High grass and weeds or vegetation over eight-inches (8") in height is considered a violation of this chapter.
   Reports of high grass and weeds can be made by calling 740-622-1465 or 740-623-5922 or by going to the cityofcoshocton.com website and clicking on "report a code violation". The property code inspector will follow-up and inspect all reports, as well as proactively work to identify properties needing attention.
   (b)    Notice. If the property code inspector or administration official determines that a violation exists, a Notice of Violation will be issued that will give a property owner or the occupant of the property, the opportunity to correct the situation. From the Notice of Violation date, the property owner will have seven (7) days to abate (correct) the violation. After the seven (7) days have expired, the property will be re-inspected. If the violation has been abated, no further action will be taken. If the owner has NOT abated the violation, the property code inspector will document via photographs and arrange to have the property mowed. Photos will also be taken (before and after) to document for property file.
   (c)   Cost. If the City of Coshocton abates a high grass and/or weed violation for a parcel of land, the property owner will receive an invoice for mowing and administrative costs. An invoice total is based upon the total time and labor involved in not only mowing, but also any property clean-up required before mowing. The charges will be as follows:
      (1)   Mowing fee one hundred dollars ($100.00) for the first hour or any portion of an hour. Fifty dollars ($50.00) per hour per employee for every hour or portion of an hour after the first hour and a fifty dollar ($50.00) administrative fee.
      (2)   Clean-up fee of one hundred dollars ($100.00) for the first hour or any portion of an hour. Fifty dollars ($50.00) per hour per employee for every hour or portion of an hour after the first hour. One hundred fifty dollars ($150.00) dumping fee and fifty dollars ($50.00) administrative fee.
    The City will file a lien against the property for collection through the following year's property tax assessment. (Ord. 34-22. Passed 7-27-22.)
