(A) No public servant shall accept any compensation, honorarium or gift in consideration of an appearance, speech or article under circumstances in which it could be reasonably be inferred that the compensation, honorarium or gift was intended to influence or could reasonably be expected to influence the public servant in the performance of his or her public duties. Provided, however, that there shall be a rebuttal presumption that the acceptance by a public servant of compensation, honorarium or gift having a value of less than one hundred dollars ($100.00) was not intended to influence the public servant in the performance of his or her public duties.
