(a) Whoever violates any provision of this chapter, or fails to comply with any final order as provided herein, shall be guilty of a minor misdemeanor and shall be fined not more than one hundred dollars ($100.00). A separate offense shall be deemed committed each day on which a violation or noncompliance occurs or continues.
(b) Whoever violates or fails to comply with any of the provisions of this Chapter, or fails to comply with any final order as provided herein, on more than one subject manner in any two-year period separate and distinct from a conviction upon a prior subject matter or any continued daily violation of such prior subject matter, shall be, upon such subsequent conviction within two years, guilty of a misdemeanor of the first degree and shall have sentence imposed pursuant to Section 501.99 of the General Offense Code. A separate offense on such subsequent subject matter within two years shall be deemed committed each day on which a violation of noncompliance occurs or continues.
