(a) The tariff charge shall be based on the gallons of water metered into the premises.
(b) That it is hereby determined and declared necessary for the due protection of the public health, safety and welfare of the City of Cortland, Ohio to establish and collect charges or the use of the System, upon all lots, lands and premises having connection with the System.
(c) That for the aforesaid purposes there is hereby levied and charged upon each lot, parcel of land or premises, having a connection with the system or otherwise discharging sewage, industrial wastes, water or other liquids, either directly or indirectly into the system, sewer charges payable as hereinafter provides as follows:
(1) A minimum charge of fifty-eight dollars and thirty cents ($58.30) per quarter shall be charged for each billing unit for the first 6,000 gallons based on water meter readings. A minimum charge of nineteen dollars and forty-three cents ($19.43) per month shall be charged for each billing unit for the first 2,000 gallons based on water meter readings.
(2) An additional charge of seven dollars and five cents ($7.05) per each additional 1,000 gallons after the minimum gallons usage shall be made based on the quarterly or monthly billing.
(d) Users not connected to the City of Cortland water system shall have a Single Residential Equivalent (SRE) calculation based on the structure, use and type. The SRE will be calculated using the Trumbull County Sanitary Engineering flow guidelines. The sewer use rate for one (1) SRE will be estimated using the Ohio EPA monthly flow average (7,756 gallons per month) and will be one hundred eighty dollars and five cents ($180.05) per quarter or sixty dollars and four cents ($60.04) per month. The minimum usage shall apply.
(e) In the event the account of any user is not paid in full upon the due date, the said account shall carry a penalty charge of ten percent (10%) until fully paid.
(f) In a building with multiple uses, each individual apartment or business shall be considered as one (1) billing unit (unless the buildings primary use is single family residential, and the restroom facilities are not available to the public. In such case the building will be considered as one (1) billing unit.)
(g) The property owner or his agent shall be billed for sewer service. The City shall be notified in writing by the property owners or his designate. Accounts unpaid by the tenant or his agent shall be the responsibility of the property owner.
(h) In multi-dwelling units with only one water meter, the property owner or designate shall receive only one bill. There shall be no splitting of the water/sewer charges billed by the City on a single meter. Accounts unpaid the Agent shall be the sole responsibility of the property owner.
(i) In multi-unit apartments with one master meter all units will be assumed to be occupied unless the water/sewer billing department is notified otherwise and will be billed accordingly. Property owners shall be responsible for all charges.
(j) Sewer service bills will be sent for two consecutively estimated bills or phoned in readings by the customer; then the meter shall be read by the meter reader. Customers shall make an appointment to have the meter read if they are not at home or available during regular hours. If arrangements are not made to have the meter read, then service shall be disconnected until the meter is read and a turn-on fee of sixty dollars ($60.00) is paid.
(k) Any account sixty (60) days delinquent shall have service discontinued until the account is paid in full and turn-on fee of sixty dollars ($60.00) is paid.
(l) There shall be a thirty-five dollar ($35.00) return payment fee.
(m) There shall be a ten dollar ($10.00) bank notification of account correction or change fee.
(n) The recorded gallons used on the meter shall be the amount of gallons charged for sewer.
(o) The following are the terms and conditions of tap-in fees to be charged by the City of Cortland:
(1) A family unit as set forth herein shall be any single family dwelling or any family unit or apartment within an apartment building condominium, duplexes, or other multi-family structure.
(2) The rate to be charge by the City of Cortland, Ohio for sewer tap fees shall be four hundred ninety-five dollars and no cents ($495.00) per family unit regardless of number of units in any one structure.
(3) All commercial sewer tap rates shall be charged at the rate of four hundred ninety-five dollars and no cents ($495.00) for each commercial enterprise or enterprises contained in any one building or structure.
(4) All industrial sewer taps shall be charged at the rate of one thousand two hundred dollars and no cents ($1,200.00).
(5) The sewer tap fees charged and collected herein by the City of Cortland, Ohio shall be apportioned as follows:
Ten percent (10%) of cost to go to General Operation of Sewer Revenue Fund, the balance of each sewer tap fee shall be placed in the comprise Sewer Capital Fund for the payment of the expenses of improvements to trunk lines, improvements to pump stations and retirements of any other expenses or sewer bond indebtedness pertaining to the improvement and repair of sewer system of the City of Cortland, Ohio.
(p) That a special sewer tap-in rate is established for non-profit housing corporations or associations which produce housing for senior citizens is hereby provided in the amount of two hundred dollars ($200.00) for each family unit.
(1) If at any time the said non-profit housing corporations or associations dispose of any of the housing units (to any other than another non-profit corporation or association) upon which this special rate has been allowed, then and in that event, the non-profit corporation or association so disposing of the said family units shall pay an additional two hundred ninety-five dollars ($295.00) for each family unit so disposed of. This payment of two hundred ninety-five dollars ($295.00) shall be an additional charge for the sewer tap-in fee and will make said rate comparable to the rate charged to the other than non-profit corporations, associations, and individuals.
(2) The building known as the Community building in said housing project shall be charged the rate of two hundred dollars ($200.00) per tap. With the same stipulation as stated for additional charge should building be disposed of.
(3) This additional charge shall be made a condition of any sale, disposition or transfer and shall be paid prior to the actual sale, disposition or transfer.
(q) That a special sewer tap-in rate for those owners of land, buildings or structures lying outside of the City of Cortland corporation limits desiring to tap into the City of Cortland's sewer lines is hereby provided in the amount of nine hundred and ninety dollars ($990.00) for each such unit.
