(a) In the event the cut in the street or road is not replaced back in its original condition, the City shall have the right to use any or all of the one thousand dollar ($1,000) deposit to properly repair such cut.
(b) Upon the completion of the repair of the excavation work such cut or cuts shall be inspected by the Service Director and he shall provide the Clerk of Council with a note stating the cut or cuts were repaired properly and the street or road is now in the same condition in which it was prior to making such cut or cuts.
