761.24 YEARLY MAINTENANCE REQUIREMENT FOR NEW AND EXISTING WELLS.
   (a)   Annual Inspection Fee. An annual inspection fee of one hundred dollars ($100.00) to be paid by July 1, or each calendar year. Any oil and/or gas well existing prior to the passage of this Zoning Ordinance shall pay this fee beginning July 1, 1998. All new wells drilled in accordance with this chapter shall pay this fee commencing the third year after the Permit is issued.
 
   (b)   Maintenance and Security Bond. An annual maintenance and security bond in the amount of five thousand dollars ($5,000.00) shall be provided the City for each year the gas and/or oil well remains in existence to ensure the provisions of this chapter are adhered to. This bond shall be maintained in the office of the Director of Public Service. Upon written notification by the City to the permittee of any discrepancies in regard to this chapter, the permittee shall correct same within thirty days of this notice or the City shall take the appropriate action, utilizing this bond, to correct the discrepancies.
 
   (c)   Maintenance of Premises. The premises shall be kept in a clean condition, free from rubbish of every character, to the satisfaction of the Director of Public Service or his designate, at all times during which the drilling operations or reworking operations are being conducted, and as long thereafter as oil or gas is being produced therefrom. The well site shall not be used for any other purpose except to conduct normal oil and gas production operations. The well site shall not be used for the storage of pipe, equipment, etc. (except for that equipment required for safety purposes), or materials, except during the drilling or servicing of the well or of the production facilities.
 
   (d)   Oil and Gas Facilities. All oil and gas facilities shall be painted deep forest green and maintained in a good state of appearance. The facility shall have posted in a prominent place a metal sign no less than two square feet in an area upon which the following information shall be conspicuous:
      (1)    Permittee's name.
      (2)    Lease name.
      (3)    Location of the drill site.
      (4)    Identifying number of the permit issued by the State Department of Natural Resources Division of Oil and Gas.
      (5)    A number to contact permittee in case of emergency.
 
   (e)   Brine Hauler. The Permit Holder shall notify the City yearly as to where the brine will be hauled to waste.
 
   (f)   Fencing. The Permit Holder shall keep in good repair. All gates thereto shall be keep locked when the permittee or his employers are not within the enclosure. The fence shall be painted dark forest green.
 
   (g)   Storage Tanks, Separators and Pumps. The Permit Holder shall keep tanks, separators and pumps in good repair. All tanks shall be kept diked or other suitable means taken so as to present discharge of liquid. The tanks shall be painted dark forest green.
 
   (h)   Security. All gates, storage tanks, manholes, discharge valves, fill valves, shutoff valves, and fence gates shall be locked. All locks at a given well shall utilize a master key.
 
   (i)   Access Drives. Access drives shall be adequately fenced and have a gate with a locking device to prevent unauthorized entry. The drives, fences, and gates shall be maintained by the permit holder for the life of the well.
