(A) Arrests without warrant for certain offenses. Act No. 25 of 1995, 42 Pa.C.S.A. § 8902 (the “Act”), authorizes police officers within the state to make an arrest without warrant upon probable cause for, inter alia, the following enumerated offenses when there is ongoing conduct that imperils the personal security of any person or endangers public or private property:
(1) Violation of 18 Pa.C.S. § 5503 (relating to disorderly conduct);
(2) Violation of 18 Pa.C.S. § 5505 (relating to public drunkenness);
(3) Violation of 18 Pa.C.S. § 5507 (relating to obstructing highways and other public passages); and
(4) Violation of 18 Pa.C.S. § 6308 (relating to purchase, consumption, possession or transportation of liquor or malt or brewed beverages).
(B) Procedures to be followed in making warrantless arrests. When making a warrantless arrest pursuant to Act 25 of 1995, 42 Pa.C.S.A. § 8902 for violation of the offenses enumerated therein, city police officers shall follow the guideline attached to the resolution codified herein as Exhibit A entitled Policy for Warrantless Summary Arrests, which guidelines are incorporated herein as though fully set forth at length.
