9-3-1: DRIVING UNDER INFLUENCE OF LIQUOR, DRUGS:
   A.   Liquor: It is unlawful and punishable as provided in subsection C of this section for any person who is under the influence of intoxicating liquor to drive or be in actual physical control of any vehicle within the city.
   B.   Narcotic Drugs: It is unlawful and punishable as provided in subsection C of this section for any person who is a habitual user of or under the influence of any narcotic drug, or who is under the influence of any other drug to a degree which renders him incapable of safely driving a vehicle, to drive a vehicle within the city. The fact that any person charged with the violation of this section is or has been entitled to use such drug under the laws of this state shall not constitute a defense against any charge of violating this section.    C.   Penalty: Every person who is convicted of a violation of this section shall be subject to penalty as provided in Montana Code Annotated title 61, chapter 8, part 4. (1975 Code § 9-3-1; amd. 2015 Code)
