917.13 APPEAL PROCESS.
   (a)   The property owner of a tree located on private property has the right to appeal the notice given by the Department to the Tree Appeal Board on a form provided by the Department and provide any supporting documentation that such notice was issued in error.
 
   (b)   The Tree Appeal Board shall consist of a Council Member not associated with the Tree Commission, a Tree Commission member, and the City Manager. The Appeals Board shall schedule a hearing of an appeal within thirty (30) days of when such appeal has been filed.
 
   (c)   Minutes shall be taken and a formal decision shall be sent to the appellant landowner of the Board's decision.
 
   (d)   Should the landowner fail to comply with the decision of the Board within thirty (30) days or a date as agreed upon after the order has been affirmed by the Appeals Board, the Department shall certify noncompliance and request the Law Director to take the necessary legal action to comply with said order.
