917.08 PROTECTION OF TREES AND SHRUBS.
   Unless a permit has been issued by the Department, it shall be unlawful for any person to
do the following to any tree(s) in or upon treelawns, parks or other public places:
   (a)   Fasten any sign, card, poster, wire, rope, or other material to, around, or through any tree or its guard, except in emergencies such as storms or accidents, except for any nursery tag identifying its species or care and staking for stability of newly planted trees.
   (b)   Break, injure, mutilate, kill, cut, peel or destroy any tree or shrub by any means or in any manner, except that any public utility may as allowed by law, without a permit, to trim and remove trees and/or shrubs in reasonable fashion when necessary to ensure the operation and maintenance of the utility.
   (c)   Permit any fire to burn where the fire will injure any portion of any tree or shrub.
   (d)   Permit any toxic chemical to seep, drain or to be emptied on or about any tree or shrub.
   (e)   Deposit, store, place or maintain on any treelawn, parkway, park, or other public place, any brick, sand, stone, concrete or other materials which may impede free passage of water, air and fertilizer to the roots of any tree or shrub growing therein.
   (f)   Knowingly fail to repair or stop any leak existing or occurring in any gas pipe or main within a radius of forty (40) feet of any tree.
   (g)   Knowingly permit any electrical wire to be installed in contact with any tree or shrub.
   (h)   A contractor shall take all precautions while excavating in the treelawn to protect the tree growing therein in accordance with City policies.
   (i)   When a driveway is installed in the City treelawn, the contractor shall work with the Department to minimize the driveway's impact upon any tree or shrub located in the area the driveway is to be installed.
   (j)   Plant any prohibited species of tree, as herein defined under Section 917.03 Definitions and as determined by the Department and/or Tree Commission.
