917.06 PERMITS.
   (a)    Tree Planting.
      (1)    No person shall hereafter plant upon any treelawn, street, park or public place in the city, nor cause such act to be done by others without first obtaining a permit from the office of the Public Service Department. Minor pruning or trimming to maintain minimum branch clearances for the benefit of pedestrian or vehicle passage shall not require a permit.
      (2)    Persons receiving the permit shall abide by the ordinances and policies adopted by the City.
 
   (b)   Application for Permits. Application for permits must be made at the office of the Public Service Department in advance of the work being done. No work shall be started until the permit is issued except for minor trimming.
 
   (c)    Permit Expiration.
      (1)    Each permit granted shall contain an expiration date and the work shall be completed within the time allowed in the permit and in the manner therein described.
      (2)    Any permit issued shall be void if its terms are violated or if the work described is not substantially completed by its expiration date.
      (3)    A Permit may be extended up to thirty (30) days upon written notice from the applicant and upon approval of the City.
 
   (d)    Permit Contents.
      (1)    Every permit issued by the Department of Public Services shall describe work to be done or state the number of trees to be planted and the locations, size, species or variety of each tree, the method of planting and other information that the Department may require to insure that the work will be done properly.
      (2)    Whenever any tree shall be planted in conflict with the provisions of the permit, it shall be lawful for the City to cause removal of the same, and the cost for the removal shall be assessed to the property owner as provided by law.
 
   (e)    Permit.
      (1)    Applicant shall pay any fee as established by the City Council or ordinance.
      (2)    In issuing any and all permits, the Department shall act promptly and shall maintain duplicate records of all permits issued and of compliance therewith.
 
   (f)    Public Utility Companies, Department of Public Service, and the Tree Commission shall be exempt from the permit requirement.
