1377.06 PROCEDURE WHEN OWNER FAILS TO COMPLY.
   (a)   Upon failure of the owner, occupant, lessee, agent or other person having charge of such lot, land, or parcel to cut or destroy such weeds, grasses, and other undesirable vegetation within the time limit following service of the “Notice of Violation”, the City Manager shall cause such noxious weeds, grasses and other undesirable vegetation to be cut or destroyed in order to abate the public nuisance.
   (b)    Such cutting and removing shall be at the owner’s expense and cost, together with an administrative fee of twenty percent (20%). The fee for the cutting or destruction of such weeds, grasses or vegetation and abating the public nuisance in accordance with this chapter, shall be a rate of one hundred fifty dollars ($150.00) per hour with a minimum charge of one hundred fifty dollars ($150.00) on the first offense and a minimum charge of five hundred dollars ($500.00) for the second and subsequent offenses. In the event the City is required to employ outside services for such abatement work, the fee shall be the actual cost of such contract, plus twenty percent (20%) for administration charges.
   (c)   In the event the City determines it necessary to remove or dispose of trash, rubbish, garbage, refuse or other materials to facilitate the cutting or destruction of such weeds, grasses or vegetation or abating the public nuisance in accordance with this chapter, said actual cost for removal or disposal shall be at the owner’s expense, together with an administrative fee of twenty percent (20%). Said costs shall be in addition to any and all other fees associated with this chapter. (Ord. 53-09. Passed 5-26-09.)
