   (a)    No person other than a duly authorized employee or agent of the City shall make any opening in or cut or remove any curb or curbing in any of the streets, alleys or other public roadways or thoroughfares within the City without first obtaining a permit to do so.
   (b)    The permit shall be issued by the City Manager, or his designee, and shall be conditioned on the fact that the permittee agrees to restore the curb to its former condition in the event the driveway or other use for which the curb was cut is abandoned or discontinued.
   (c)    A non-refundable permit fee as established by ordinance and amended as necessary shall be charged for the cutting of any curb and shall be collected at the time the permit is issued.
    (d)    A deposit as established by ordinance and amended as necessary shall be required prior to the issuance of a curb cut permit. The deposit shall be refunded by the City Manager, or his designee, if the work is completed to the Manager's, or his designee's, satisfaction and without damage to the surrounding pavement, remaining curb or treelawn.
   (e)    Driveway aprons that are newly constructed or replaced must be hard surfaced with either asphalt or concrete prior to issuing a refund of said deposit.
