375.09 PROPERTY OWNER’S PERMISSION.
   (a)   No person shall operate a snowmobile, off-highway motorcycle or all purpose vehicle over and upon any private property without first obtaining the permission of the owner or occupier of the property for such operation. Any person operating a snowmobile, off-highway motorcycle or all-purpose vehicle upon the property of another shall stop and identify himself upon the request of the owner or occupier thereof, and, if required to do so by the owner or occupier, shall promptly remove such snowmobile, off-highway motorcycle or all-purpose vehicle from the premises.
   (b)   Whoever violates any provision of this section is guilty of a misdemeanor of the fourth degree on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree and the vehicle is also subject to seizure in accordance with Section 375.09 (b) of this code; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the second degree.
