373.12 OPERATION OF MINI-BIKES, TRAIL BIKES AND SIMILAR MOTOR VEHICLES.
   (a)   Motor vehicles whose design is predominately intended for operator or passenger transportation purpose usually connected with sports or recreation, and which cannot be or is not registered with the Bureau of Motor Vehicles of the State of Ohio and for which this State does not issue license plates, commonly known as mini-bikes, go-carts, scramblers and trail bikes, and all similar motor vehicles, whether licensed by a foreign state or not, and all other motorcycles that do bear registration or license plates:
      (1)   Shall be equipped with a manufacturer’s standard muffling device in constant operation and good working order or, if a custom-made motor vehicle, the similar equivalent thereof upon a like manufacturer’s standard vehicle. Said motor vehicles shall also be equipped with a muffler system including sound dampening equipment such that noise does not exceed 82 decibels on “A” scale at 50 feet measured according to SAE J192 (effective September 1970).
      (2)   Shall not be operated upon any private property within the corporate limits without the express and written consent of the owner(s) or the legal occupier of said real premises unless the operator or his mother and/or father or legal guardian owns or legally controls such premises. Such written permission shall be carried upon the person of all operators at all times when he is so operating upon premises owned or controlled by others than himself or his parents or legal guardian.
      (3)   Shall not operate such motor vehicles in a reckless manner upon private premises as prescribed by Ohio R.C. 4511.201.

   (b)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
