§ 92.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99.
   (B)   (1)   Any person who shall violate any of the provisions of §§ 92.01 through 92.09, 92.20 through 92.30 and 92.40, or who shall fail to comply with any judicial warrant, lawful, order or regulation made thereunder or who builds in violation of any specifications or plans submitted and approved thereunder or any permit issued thereunder, shall be guilty of a misdemeanor. Each day that the violation continues shall constitute a separate offense. In the name of the town, the Fire Department, through the Town Attorney, may enjoin the construction or erection of any facility, building or structure which does not conform to the provisions of the code.
      (2)   The Fire Prevention Code may be enforced by any of the remedies set forth in G.S. § 160A-175, in addition to others specifically set out herein or in this code of ordinances.
      (3)   Any person who violates any of the provisions of §§ 92.01 through 92.09, 92.20 through 92.30 and 92.40 shall be subject to a civil penalty for each violation in the amount established by the ordinance of the Town Council. See Town Civil Penalty Schedule. Each day of violation shall constitute a separate and distinct offense.
      (4)   In the event the owner or occupant of any business or commercial building or structure does not eliminate or correct existing fire hazards after being notified thereof within the time hereinabove specified, both the occupant and the owner shall be guilty of a misdemeanor and shall be fined not more than $50 or imprisoned for not more than 30 days. For each day the occupant or owner allows the fire hazard to exist after the expiration of the period hereinabove set forth for correcting or eliminating the same, such shall be considered a separate violation of the law and the penalty hereinabove provided may be assessed for each and every day the violation exists. In the event the Fire Department deems it advisable and for the best interest of the citizens of the town the Fire Department may through the office of the District Attorney seek an order from the District Court of the county to require that the business or commercial structure be closed until such time as the existing fire hazard has been eliminated or corrected.
   (C)   Any person who shall violate § 92.40 shall be guilty of a misdemeanor. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to cease and desist therefrom when commanded by the Fire Department to do so.
