§ 874.01 PURPOSE AND INTENT.
   The purpose and intent of this chapter is as follows:
   (a)   The purpose of this chapter is to protect and promote the health, safety, and general welfare of all the residents of the City of Columbiana and to attempt to preserve the small-town atmosphere for which the community is known through the requirement that any person wishing or intending to operate a short-term rental unit within the city shall be required to conform with the requirements as set forth within this chapter. It is also the purpose of this chapter to protect the character and integrity of the city’s residential neighborhoods while at the same time providing real property owners, within certain areas of the city, with the opportunity to receive remuneration from the short-term rental of their property or properties.
   (b)   Short-term rentals as provided for in this chapter shall be limited to the C-1 Local Commercial District, the C-2 Office and Limited Business District, the C-3 Central Office District, the C-4 Intensive and Automobile Oriented Commercial District, and the C-5 Highway Commercial District within the city. A further purpose of this chapter is to:
      (1)   Establish minimum standards and conditions for short-term rentals that reflect the goals and policies of the city as set forth within this Code;
      (2)   Emphasize and reinforce the purpose of the separation of the residential neighborhoods, occupied by families and children, from uses that normally generate greater traffic and congestion from that normally seen from or by local traffic in residential neighborhoods of the city;
      (3)   Acknowledge that the C-4 Commercial District of the city due to its already increased traffic, activity, vibrancy, and congestion generated by the uses located therein are better suited locations for the placement of short-term rentals and that by so placing or permitting such uses in such Commercial District, the city will be promoting the goals of the safety and general welfare of the public and will also be reducing the hazards to life and property of the residents of the city.
