§ 1246.09 REVIEW OF PRELIMINARY PLAT BY OTHER PUBLIC OFFICIALS AND AGENCIES.
   (a)   If the proposed subdivision is located in an area not served by a public water or sanitary sewerage system, the Planning Commission shall transmit one copy of the maps and data accompanying the application to the County Board of Health, for a determination of whether or not proposed methods for the disposal of sewage are adequate and whether or not they will create a nuisance or pollute the water supply.
   (b)   If the proposed subdivision is located in an unincorporated area within the one and one-half mile jurisdiction of review by the municipality, the application for preliminary plat approval shall be submitted to the Planning Commission and a copy of the maps and data accompanying the application shall be transmitted to the County Planning Commission, the County Board of Health, the Sanitary Engineer, the County Engineer and the Board of Zoning Appeals.
   (c)   If the proposed subdivision is located within 300 feet of the centerline of a proposed new highway or a highway for which changes are proposed, as described in the certification to local officials by the Director of the State Department of Transportation of any land within a radius of 500 feet from the point of intersection of such centerline with any public road or highway, the Commission shall give notice, by registered or certified mail, to the Director. The Commission shall not approve the plat for 120 days from the date the notice is received by the Director. If the Director notifies the Commission that he or she shall proceed to acquire the land needed, then the Commission shall refuse to approve the plat. If the Director notifies the Commission that acquisition at this time is not in the public interest, or upon the expiration of the 120-day period or any extension thereof agreed upon by the Director and the property owner, the Commission shall, if the plat is in conformity with these subdivision regulations, approve the plat.
