3.3.412: QUALIFICATIONS OF DRIVERS:
All persons to be utilized as drivers of snowplowing vehicles must be approved by the Traffic Engineer. Each must meet the following specific qualifications, to be submitted for approval to the Traffic Engineer:
   A.   Age: All drivers must be aged eighteen (18) years or older.
   B.   Driver's License: Each driver must possess a valid Colorado driver's license permitting operation of the type of vehicle driven.
   C.   Physical Condition:
      1.   Each driver must establish by means of a report of a physical examination conducted by a person licensed to practice medicine by the State of Colorado, that the driver is of sound physique, with good eyesight and not subject to epilepsy, vertigo, heart trouble, drug or alcohol addiction or any other infirmity of body or mind which might render the driver unfit for the safe operation of a snowplowing vehicle.
      2.   A report of physical examination submitted shall be valid during the license period when submitted and for one subsequent license renewal period unless the Traffic Engineer shall direct otherwise.
   D.   Driving Record: Each operator must submit a copy of the driver's driving record as maintained by the Colorado Department of Revenue plus, if the applicant has not been licensed to drive a motor vehicle by the State of Colorado during the full three (3) year period prior to the date of the application, copies of all records maintained by the State or states in which the applicant was licensed during that three (3) year period.
   E.   Driver Approval:
      1.   Each driver must submit an affidavit stating whether the driver has been convicted of a misdemeanor or felony involving alcohol or drug abuse or misuse, driving under the influence of drugs or alcohol, reckless driving, or other moving traffic violations during the five (5) years prior to and including application, and listing the date, place and charge of any conviction suffered.
      2.   The City Traffic Engineer may refuse the application of any driver whose police record shows any conviction per subsection E1 of this section, or which indicates the driver should not be entrusted with operating a snowplowing vehicle on the public streets.
      3.   The City Traffic Engineer may refuse the application of any driver whose traffic record shows convictions for repeated moving traffic violations occurring during the three (3) years immediately prior to the date of application for the license required by this part. For the purposes of this section, the term "Moving Traffic Violation" shall include any traffic offense whether committed within the State of Colorado or elsewhere, for which penalty points could have been assessed against the applicant's driving privilege by the Colorado Department of Revenue had the offense been committed in Colorado. "Repeated" shall mean conviction of an adjudication of guilty of four (4) or more moving traffic violations during the three (3) year period prior to the date of application, conviction, or adjudication of guilt of any one or more moving traffic violations which, either alone or together, would have been sufficient to warrant the suspension of the applicant's driving privilege in the State of Colorado, or conviction or adjudication of guilty of any offense involving the operation of a motor vehicle while under the influence of or while the applicant's ability was impaired by either alcohol, drugs or any other intoxicant. 3.3.413: REVOCATION AND SUSPENSION:
The following shall be grounds for suspension or revocation of the license issued under this part:
   A.   Conviction of any driver of the offense of reckless driving or driving under the influence of or while ability is impaired by alcohol, drugs or any other intoxicants.
   B.   Conviction of any driver of repeated moving traffic violations. For the purpose of this section, the term "Moving Traffic Violations" shall be as defined in this part. The term "Repeated" shall mean conviction of three (3) or more moving traffic violations during the period for which the license was issued.
   C.   The licensee fails to file any certificates of insurance, bonds, documents, reports or other information required pursuant to this chapter or as may be reasonably required by the City Traffic Engineer or other City officer or agency;
   D.   The licensee or any agent or employee of the licensee violates any provision of this chapter pertaining to the license or any rule, regulation, or order, relating to the license lawfully made under the authority of this chapter. (Ord. 88-193; Ord. 01-42)
3.3.414: RULES AND REGULATIONS:
   A.   The City Traffic Engineer shall adopt in writing the reasonable rules and regulations, not inconsistent with the provisions of this part or of general law, as deemed necessary, advisable or expedient to carry out or enforce these provisions.
   B.   Copies of the Engineer's rules and regulations shall, when adopted, be available for distribution at the City Traffic Engineer's Office.
   C.   It shall be the duty of every operator and every driver as licensed under the provisions of this article to observe the Engineer's rules and regulations.
   D.   Any violation of any rule or regulation duly adopted by the City Traffic Engineer shall be deemed a violation of this article. The City Traffic Engineer shall have full authority to revoke or suspend any license issued under this part, at the Engineer's discretion, for violation of any provision of this part or any rule or regulation made hereunder. 3.3.415: CERTIFICATION:
Upon compliance with the requirements of this part, a written notice to proceed may be issued by the Traffic Engineer to the contractor with a license. In no case will a contractor mobilize equipment for snow or ice removal without this notice. Violation of the requirements of this article may be cause for revocation of the notice to proceed and revocation of the license. (Ord. 88-193; Ord. 01-42)

3.3.501: LICENSE REQUIRED:
No person shall construct or repair a sidewalk, curb and gutter, or driveway, or contract to construct or repair a sidewalk, curb and gutter, or driveway within the City right of way without first obtaining a license and a permit to do so, except as otherwise provided in this part. No license or permit shall be issued except as provided in this part. (Ord. 05-135)
3.3.502: APPLICATION FOR LICENSE; FEES, TERM:
Any person desiring a license shall submit an application on forms provided by the City Clerk's Office in accord with the City's General Licensing Code. All applications for a concrete contractor license shall contain those matters required by section 2.1.403 of the City Code. The license shall be issued by the City Clerk upon payment of the required fees as established by City Council under chapter 2, article 1, part 5 of the City Code. All licenses issued under this part shall, unless sooner suspended or revoked, expire one year from the date of issuance, and the license may be renewed no later than thirty (30) days after the expiration upon payment of the required fees.
