5-4B-3: ANIMAL YARDS:
   A.   Definition: As used in this section, the following words and terms shall have the meanings ascribed to them in this subsection:
    POULTRY OR ANIMAL YARD: Includes every enclosure, shed or structure used to house two (2) or more rabbits, or other domestic animals.
   B.   Location: It shall be unlawful to maintain in the City any animal within twenty five feet (25') of any building used for residence purposes by anyone other than the one maintaining such animal yard or his/her immediate family, or within twenty five feet (25') of any public way, other than an alley, or within one hundred feet (100') of any church or school building.
   C.   Sanitary Condition: Every person maintaining an animal yard shall keep the same clean and sanitary, and free from all refuse. Such yards shall be thoroughly swept at least once every twenty four (24) hours, and it shall be unlawful to permit any decaying food or other refuse of any kind to remain in such yard. Refuse from such yards shall, when swept up or collected, be kept in airtight containers until disposed of in accordance with this Code, and it shall be unlawful to permit any such refuse to remain recovered.
   D.   Enclosure Of Yard: Every animal yard shall be adequately enclosed so as to be impenetrable against rats or other rodents. The presence of any rats in the animal yard shall be prima facie evidence that such yard is maintained in violation of the provisions of this section.
   E.   Limitation Of Number Of Domestic Animals Other Than Dogs And Cats: No person shall harbor or keep over six (6) animals. (1997 Code)
   F.   Penalty: Anyone found guilty of violating this section shall be subject to penalty as provided in section 1-4-1 of this Code. (Ord. 0-19-01, 2-25-2019)
