5-1-3: CHIEF OF POLICE:
   A.   Head Of Department: The chief of police shall be the head of the department and have supervision over all officers and members thereof. The chief of police shall be allowed to flex his/her daily schedule to attend required meetings of the corporate authorities. The chief of police shall be under the direction of the collective corporate authorities. No one member of the corporate authorities has the authority to act alone to direct the chief of police. If there arises a public safety emergency situation, the mayor, in the absence and consent of the aldermanic council, shall have the authority to direct the chief of police in the time of a public safety emergency.
   B.   Mayor To Appoint: Mayor is hereby empowered to make appointments to the police department of the city by and with the advice and consent of the city council, and shall have power to make necessary rules setting forth the qualifications necessary for appointment to the said department.
   C.   Responsibilities: The chief of police shall keep such records and make such reports concerning the activities of the police department as may be required by statute, by ordinance or by the city council. The chief shall be responsible for the performance by the police department of its functions. All persons who are members of the police department shall serve subject to the orders of the chief of police.
   D.   Chain Of Command: Shall there arise a matter within the police department where there may be a grievance of the subordinate members of the police department with the chief of police, the chain of command will be followed as prescribed by the current internal policies and/or by the prescription of remedies mutually agreed to in the current bargaining agreement.
   E.   Chief Of Police Compensation: The compensation provided for the police chief shall be as fixed by the council from time to time.
   F.   Duties: It shall be the duty of the chief of police to see to the enforcement of all of the provisions of the bargaining agreement, all other written city policies or ordinances in effect that do not conflict with the FOP bargaining agreement, shall be enforced.
   G.   Authority To Alter Bargaining Agreements, City Code, And All Other Written City Policies: The chief of police does not have the authority to supersede or alter any provisions agreed to in writing within the bargaining agreement during its prescribed term at any time as a temporary or permanent verbal agreement. The chief of police must have the permission of the corporate authorities to supersede or alter all other written city policies or ordinances. The corporate authorities do not have the authority to supersede or alter any provisions agreed to in writing within a bargaining agreement during its prescribed term, after acceptance of said agreement, unless both the city and the bargaining unit agree to mutually open the contract with the intent to bargain the existing language during its prescribed term.
