4-1-1: NUISANCES ENUMERATED:
The following acts and conditions are declared to be nuisances:
   A.   Unlawful Act: It shall be unlawful to permit or do any act which endangers the public health or results in annoyance or discomfort to the public. [65 ILCS 5/11-20-5]
   B.   Depositing Substances In Canal, Public Ways:
      1.   No person shall throw, place or deposit or cause to be thrown or deposited, any dung, carrion, dead animal, offal, putrid or unwholesome substance, or the contents of any privy into the canal within the limits of the City or upon any street, alley or public grounds, and upon any lot within the limits of the City.
      2.   It shall be unlawful to throw, place or deposit or cause to be thrown or deposited, any unsightly substances on any public property of the City. [65 ILCS 5/11-20-4, 740 ILCS 55/221 subd. 1, and 55/221b]
   C.   Garbage And Refuse:
      1.   Burning Refuse: It shall be unlawful to burn any incombustible or other organic refuse outside a lawfully constructed incinerator, so as to permit said refuse to be blown away by the wind. No person shall cause to be burned any refuse at the front of a lot or near public streets. [415 ILCS 5/9(d)]
      2.   Disposal Of Garbage: It shall be unlawful to place or permit to remain within the City any garbage or other materials subject to decay, excepting in tight containers with tight-fitting lids not in excess of thirty three and one-half (331/2) gallons. It shall be unlawful to permit to fall from any vehicle any garbage, refuse or ashes on any public street in the City; provided, that this subsection shall not be construed as prohibiting the placing of garbage, refuse or ashes in a container complying with the provisions of this Title for the purpose of having such matter collected and disposed of 1 .       3.   Place Refuse For Collection: It shall be unlawful for any resident within the City to place for more than twenty four (24) hours any refuse or garbage intended for disposal collection on or along or next to City streets, alleyways, and other travelled areas where refuse collection is made.
   D.   Sale Of Unwholesome Food And Drink: It shall be unlawful to sell or offer for sale any unwholesome or polluted food or drink of any kind in the City. [65 ILCS 5/11-20-2]
   E.   Pollution Of City Water Supply: It shall be unlawful and a nuisance for any person to obstruct or pollute any watercourse or source of water supply in the City. [740 ILCS 55/221 subd. 3]
   F.   Stagnant Pools Of Water: Any stagnant pool of water in the City is hereby declared to be a nuisance. It shall be unlawful for any person to permit any such nuisance to remain or exist on any property under his or her control. [65 ILCS 5/11-20-4]
   G.   Discharging Polluting Substances: It shall be unlawful for any person to connect or cause to be connected, any drain carrying or to carry any toilet, sink, basement, septic tank, cesspool, industrial waste, or any fixture or device discharging polluting substances to any storm water drain in the City. [605 ILCS 5/9-123]
   H.   Smoke Emission: It shall be unlawful to cause or permit the emission of dense smoke from any fire, chimney, engine, oil burner or other agent in the City so as to cause annoyance or discomfort to the residents thereof. For the purpose of testing and grading the density of smoke, the Ringelmann Smoke Chart as published and used by the United State Geological Survey shall be and is hereby adopted as a standard for such grading and the smoke shall be and is hereby defined as declared to be "dense" when it is of a degree of density of number 3 of said chart, or greater, for more than six (6) minutes in any one hour whether such period of time is consecutive or not.    I.   Swimming In Canal: There shall be no swimming within the limits of the City except adjacent to places where there are available showers and suitable places for changing of clothes. No person, regardless of the facilities, shall swim in the canal.
   J.   Deposits In Ditches: It shall be the responsibility of landowners to maintain ditches abutting such owner's property free from debris, trash and other nonindigenous objects which may constitute a health or safety hazard. Any owner who fails or refuses to maintain abutting ditches free of debris, trash and other nonindigenous objects after proper notice to such owner by the City shall be subject to penalty as provided in Section 1-4-1 of this Code.
   K.   Firewood Stacks: Firewood shall be stacked in a neat and orderly manner in the side or rear yard of a residence. Residents shall be allowed two (2) weeks from the date the wood is obtained to comply with this Chapter. Failure to comply with this regulation is hereby declared a nuisance and is unlawful. [65 ILCS 5/11-53-1]
   L.   Cluttered, Discarded Or Abandoned Items: It is hereby declared a nuisance and unlawful to maintain premises cluttered with discarded or abandoned items of personal property or with tools or personal property used in a business or trade or to leave such objects haphazardly upon such premises.
   M.   Landscape Waste: It is hereby declared a nuisance and unlawful to allow piles of brush and/or fallen or cut tree limbs to remain on the premises from which it was grown. No piles of brush, tree limbs or grass clippings shall be allowed to be brought from a premises from which it was grown to another premises unless it is a landfill or compost site approved by the Illinois Environmental Protection Agency.
