(A) Town Judges shall collect, in addition to the fine, a Town Court fee of $61 on violations of Town ordinances, and the maximum permissible fee under state law for state statutory violations, together with the appropriate state litigation tax and the appropriate town litigation tax (Ordinance 2006-19, passed 9-25-06). A fee of $12.50 in addition to the above shall be collected on all violations for public defender costs and the funds forwarded to Shelby County Government.
(B) For each continuance requested by the defender, the maximum permissible fee under state law will be charged.
(C) At the time of a conviction for DUI, driving without a license, suspended license, canceled license and/or revoked license, or any offense which requires a certification of payment and fines to the State of Tennessee for reissuance of licenses, the maximum permissible fee under state law will be charged for such certification.
(D) In cases where a defendant's record is to be expunged due to completion of diversion, the maximum permissible fee under state law will be charged.
(E) If the defendant chooses to enter a plea of guilty to the offense(s) charged, pay the forfeit on his or her traffic citation, and waive his or her right to a trial, the forfeit will have the same force and effect as a guilty judgment taken by the court, but without court cost and applicable fees. Any fine, court cost and fees shall be deposited in the General Fund of the Town.
(F) In addition to posted fines, all forfeitures will be assessed court costs.
(G) In cases where a Judge deems appropriate, a clerk's fee of up to $100 may be assessed. In addition to posted fines, all forfeitures will be assessed a forfeiture fee of the maximum permissible fee under state law.
(H) Traffic citations remaining unpaid for 20 days shall be assessed a forfeiture fee and applicable court costs.
(I) The Town may engage the services of a collection agency to collect fines and costs assessed by the municipal court where such fines and costs have not been collected within 60 days after they were due; provided, however, that such engagement may only be made by written contract between the Town and such collection agency.
(J) An electronic citation fee of five dollars ($5) shall be collected on each citation for violation of any traffic ordinance that results in a plea of guilty of nolo contendere or a judgment of guilty. Such fee shall be assessable as court costs and shall be in addition to all other fees, taxes, and charges. One dollar ($1) of such fee shall be retained by the Town Clerk and used for computer hardware purchases, usual and necessary computer related expenses, or replacement. The remaining four dollars ($4) of the fee shall be transmitted monthly by the Town Clerk to the Collierville Police Department for the purpose of funding the development and operation of an electronic citation system, including related expenditures for technology, equipment, repairs, replacement, and training to maintain the electronic citation system.
