13.04.150: CONNECTION FEE; REQUIRED; DISPOSITION OF MONEYS COLLECTED:
   A.   The water rate schedule and study prepared by qualified consulting engineers shows, and the Mayor and City Council find, that the projected loss of the Coeur d'Alene Lake water source and the rapid increase of users served by the Coeur d'Alene water system requires the City to proceed with a construction program to make capital improvements to the system. Since these improvements have been made as a result of the projected increase of users of the system, they should be financed by connection fees charged to the users of new services. Such charge shall be made to owners of property making application by consumer order after February 23, 1979, for new water service connection to the City water system by direct connection, or by connection to a private water system connected to the City water system.
   B.   At the time a building permit application is filed with the City or County of Kootenai for an improvement to be served by the Coeur d'Alene water system, a connection fee shall be charged the applicant, which fee shall be in the amount as shown on Exhibit "A" attached to the ordinances codified in this Section and kept on file in the office of the City Clerk, and by reference made a part hereof, or such other amount as may hereafter be determined by resolution of the Mayor and City Council of the City, after notice and hearing, as provided for the amendment of rates, schedules, rules, and regulations, by this Chapter.
   C.   Should a potential water user apply for water services to premises for which a building permit has never been issued or has been issued without payment of the connection fee here provided for in this Section, water service shall not be initiated for such premises until the connection fee provided for in this Section, in the amount currently charged at the time of the application is paid.
   D.   All moneys received by the City as connection fees shall be by the City Treasurer placed in a special fund to be held and invested as provided by the Mayor and City Council, and as allowed by Idaho law, and shall be expended only as allowed and directed by appropriation ordinance.
   E.   No connection fee shall be charged for a meter installed on a service in existence for a minimum of twenty four (24) months which is to be used for the sole purpose of determining the quantity of water that is not discharged into the Coeur d'Alene wastewater collection and treatment system (pursuant to establishing a classification under Section 13.08.020 of this Title).
