§ 32.63 CEMETERY COMMISSION; DUTIES; OBLIGATIONS AND POWERS.
   (A)   General. The Cemetery Commission shall have the duty and obligation for the control, care and maintenance of the town cemetery.
   (B)   Adoption of rules and regulations. The Cemetery Commission shall formulate and recommend a set of rules and regulations to govern the use of, sale of, care of and maintenance of the town cemetery lots and to further formulate and recommend amendments to the rules and regulations, and deliver the recommendations unto the Board for adoption. It shall be the duty and obligation of the Board to consider the recommendations as presented to it and to enact into ordinance the rules and regulations as it shall deem to be necessary for the control, care and maintenance of the town cemetery. Upon adoption by the Board, the rules and regulations shall constitute a repeal of all prior rules and regulations heretofore enacted by the Board for the town.
   (C)   Budget requirement. The Cemetery Commission shall have the duty and obligation of submitting a budget and anticipating all its revenues and expenditures for the forthcoming fiscal year to the Board in April of each year.
   (D)   Financial report necessary. The Cemetery Commission shall have the duty and obligation of submitting a financial statement of all receipts and disbursements made by the Commission not later than the regular meeting of the Board held in August of each year.
   (E)   Deposit of funds. All moneys received by the Commission shall be maintained in a special fund bank account designated as follows: “Town of Coats - Cemetery Fund”. The bank account or accounts shall be subject to draft upon the signature of the Clerk-Treasurer or other named officer of the Commission and the Town Accountant.
   (F)   Duty to establish perpetual care. It shall be the further duty of the Cemetery Commission to formulate and recommend to the Board of the town the establishment of a perpetual care fund which will create sufficient moneys to care for and maintain the town cemetery.
   (G)   Employment of agents and employees. The Cemetery Commission shall have the power and authority to employ agents, employees, firms and corporations for the purpose of assisting the Commission in the control, care and maintenance of the town cemetery; provided that, the Cemetery Commission shall not have the power or authority to bind or in any manner contract liability against the town.
