(A) An operation permit shall not be issued to any itinerant merchant, salesperson, promoter, drummer, peddler or hawker until the person shall first display to the officials of the town a written lease or permission duly signed by a property owner or owners duly notarized by an officer who is authorized to take sworn statements under the laws of the state, the property owner or owners being the person who owns the lands upon which the business of the itinerant merchant, salesperson, promoter, drummer, peddler or hawker shall be conducted; provided further, however, that, the lands upon which the said business shall be conducted shall be appropriately commercially zoned for the business activity to be conducted on the premises; provided further that, the written permission shall designate the dates for which the operation of the business of the permittee is to be permitted.
(B) Prior to the issuance of an operation permit to any applicant who proposes to operate his business on lands adjoining the main transportation arteries of McKinley Street (N.C. Highway No. 55) and Stewart Street (N.C. Highway No. 27), the applicant shall provide five off-street parking spaces on the lands upon which he or she proposes to operate or on adjoining lands or lands nearby with appropriate signs to direct traffic to the parking; the applicant shall provide on his or her application form or separate statement, his or her plan for off-street parking in such detail as to satisfy the town of his or her plan to meet the requirements; provided that, on days and times that the town and its citizens are observing town-wide celebrations (such as the Annual Farmer’s Day event or other annual or special events) where the town expects large groups of people to attend and heavy automobile traffic, within the town, the Town Board of Commissioners may, by resolution, suspend the issuance of operation permits to applicants for operations along the main transportation arteries of McKinley Street and Stewart Street during the celebration days. Any applicant is deemed to be operating on lands adjoining the main arteries if his or her items for sale are displayed for sale within 100 feet of the street.
