§ 51.04 GARBAGE COLLECTION REGULATIONS.
   (A)   Garbage in containers shall be placed on or near the curb of the city street or road adjacent to the dwelling, establishment, store, or the like in a place that can be seen from the street or road, and which shall be convenient for the picking up and collection of the garbage.   
   (B)   Nonresidents who do not pay out-of-city bag fees shall not leave garbage in the city for pick-up. Anyone so doing will be deemed guilty of violating this chapter.
   (C)   The city is prohibited by landfill regulations from picking up any/and all liquids, oil products, yard debris (including leaves and lawn clippings), tires, vehicle batteries, metal, and wood.
   (D)   Every city garbage customer will be provided with one city garbage tote at no cost.
   (E)   A city garbage customer may be permitted to rent an additional tote from the city for an additional monthly fee, which fee shall be noted on the city garbage fee schedule.
   (F)   In lieu of renting a second or an additional tote from the city, a city garbage customer shall be permitted to use a personal garbage tote in addition to, and not in substitution of, the city provided tote. Such a second personal tote can only be used by a city garbage customer if said personal tote is substantially similar in size, appearance, and functionality as the city provided tote, with the determination of whether the personal garbage tote is substantially and satisfactorily similar to the city provided tote to be made by the appropriate city official.
   (G)   Any city garbage customer will be permitted to only use one personal tote at any garbage collection location. If any city garbage customer needs any additional tote(s) beyond the one city, provided garbage tote and one additional personal garbage tote, said customer will be required to rent any said additional garbage tote(s) from the city for an additional monthly fee, which fee is noted on the city garbage fee schedule.
   (H)   If a city garbage customer’s city provided garbage tote is severely damaged or becomes unusable as a result of normal wear and tear, by weather or other natural forces, or by city workers, it will be repaired or replaced by the city at no cost to the city garbage customer. The city will have no liability as to or responsibility for any damage which occurs to any city garbage customer’s personal garbage tote.
   (I)   City garbage customers are required to fit all of their garbage and trash inside their garbage totes so that the lid to the tote will close completely and securely. The city will not collect any garbage or trash, including any garbage which has fallen on the ground beside the garbage tote, which is outside the garbage tote.
   (J)   All garbage and trash inside a garbage tote must be in garbage bags. The city will not collect and dump any garbage and trash in a garbage tote which is not properly in bags inside the tote.
   (K)   City provided garbage totes shall always remain the property of the city. When city garbage service is suspended or terminated for any city garbage customer for any reason, the city provided garbage tote will be collected by the city and removed from city garbage customer’s site by the city.
