§ 156.144 HISTORIC CENTRAL BUSINESS DISTRICT (HCB) AND HISTORIC MIXED USE DISTRICT (HMU).
   (A)   Definition. The town has a Historic Central Business District and a Historic Mixed Use District. The HCB district covers the historic core of the town, and the regulations of this district are designed to maintain the integrity and historic assets of this area of town. The HMU district includes areas that exclude the HCB district but include the remainder of the historic sections of the town where residential uses are intermixed with commercial and other assorted uses in a small town of the town’s age.
   (B)   Permitted uses in the HCB District.
      (1)   Banks and other financial institutions, provided no such facilities include a drive-through window;
      (2)   Bowling alley;
      (3)   Church, temple, mosque, or other house of worship;
      (4)   Clinics or professional support services;
      (5)   Dancing, aerobics, gymnastics studio;
      (6)   Government facilities;
      (7)   Lodge or private club;
      (8)   Movie theater, indoor;
      (9)   General retail, not including:
         (a)   Car lots;
         (b)   Flea markets; and/or
         (c)   Auction houses.
      (10)   Public or private parking lot;
      (11)   Playhouse or dinner theater;
      (12)   Police station or fire station;
      (13)   Public library or museum;
      (14)   School, public or parochial;
      (15)   Trade or business school;
      (16)   Post office;
      (17)   Hotel or motel;
      (18)   Dwelling, limited to second floor location;
      (19)   Automotive parts and accessory sales;
      (20)   Radio, television, and music sales and service; and
      (21)   Veterinarian, without boarding.
   (C)   Permitted uses in the HMU District.
      (1)   All uses permitted in the HCB District;
      (2)   Banks and other financial institutions, with drive-through facilities;
      (3)   Dwelling, single-family;
      (4)   Public park;
      (5)   Grocery store;
      (6)   Convenience store, with pumps; and
      (7)   Wholesale produce terminal.
   (D)   Accessory uses (both districts).
      (1)   Public utility installations for local service;
      (2)   Dwelling units above the first story of a nonresidential use, provided such dwelling units have a separate primary entrance to the street (fire escapes, back stairways, and the like shall not serve as primary access). Such dwelling units shall be accessory to nonresidential primary uses only;
      (3)   Outdoor dining associated with a restaurant, provided it meets the following restrictions:
         (a)   The limits of such dining area should be clearly defined;
         (b)   The outdoor dining area shall not exceed 25% of the maximum seating capacity of the indoor dining area;
         (c)   The outdoor dining area shall not have any entertainment, music, or sound amplifying system;
         (d)   The outdoor dining area shall not be within the required yard areas; and
         (e)   The outdoor dining area shall not be operated any later than 10:00 p.m. on Sunday through Thursday or later than 11:00 p.m. on Friday and Saturday.
   (E)   Special exceptions in the HCB District.
      (1)   Exhibit, reception, and assembly halls;
      (2)   Apartments above ground floor;
      (3)   Electric appliance service and sales;
      (4)   Health spa or fitness center;
      (5)   Funeral home;
      (6)   Carpet and rug stores;
      (7)   Department store; and
      (8)   Furniture store.
   (F)   Special exceptions in the HMU District.
      (1)   All special exceptions of the HCB District;
      (2)   Crematorium; and
      (3)   Private recreational development.
   (G)   Area and height regulations for permitted uses.
      (1)   Minimum lot size.
         (a)   HCB: area of original platting; and
         (b)   HMU: 5,000 square feet.
      (2)   Minimum lot width.
         (a)   HCB: the greater of the original plat frontage or the frontage of the plat on the date of application for a permit; and
         (b)   HMU: 25 feet.
      (3)   Minimum depth of front yard.
         (a)   HCB: none, all buildings shall set to the prevailing street wall;
         (b)   HMU: the minimum depth of front yard shall be the average depth of the front yard of the other buildings on the block, except no front yard depth shall exceed five feet; (Note: buildings to be removed to clear a lot for a new building shall not be included in the calculation of average yard depth.)
         (c)   Balconies and awnings shall be permitted to encroach within sidewalk areas as follows:
            1.   Balconies: three feet provided that the minimum height of the balcony shall be greater than ten feet; and
            2.   Awnings: six feet, provided that the minimum height of the awning shall be greater than eight feet.
      (4)   Minimum depth of rear yard. Ten feet.
      (5)   Minimum depth of side yard. None, except where a use in the HCB District abuts a residential use or district, the minimum depth of the side yard shall be six feet.
      (6)   Maximum building height. Thirty-five feet, except that chimneys, cooling towers, elevator bulkheads, fire towers, water towers, transmission towers, or essential mechanical appurtenances may be erected to any height not prohibited by any other law.
      (7)   Architecture in the HCB District. In order to protect the historic resources of the downtown, all new construction and rehabilitation in the HCB District shall conform in street orientation and massing to adjacent structures. Furthermore, each new building or rehabilitation of an existing building must be built in one of the prevailing architectural styles of the District. These styles include:
         (a)   Nineteenth Century Functional;
         (b)   Twentieth Century Functional;
         (c)   Italianate;
         (d)   Neo-classical;
         (e)   Queen Anne; and
         (f)   Colonial Revival.
      (8)   Demolition in the HCB District. No permits shall be issued for the demolition of any building in the HCB District without the owner first obtaining a certificate of appropriateness from the Zoning Administrator. Such certificate of appropriateness shall only be conveyed following a public hearing and approval of the Plan Commission.
   (H)   Area and height regulations for accessory uses. Accessory uses shall be regulated by the provisions of § 156.067(A) and (B)(1)(c).
   (I)   Area and height regulations for special exceptions.
      (1)   All uses allowed by special exception shall be subject to the same development controls that apply to permitted uses.
      (2)   These regulations are set forth in division (G) above.
   (J)   Other development controls.
      (1)   Off-street parking and loading shall be provided in accordance with §§ 156.170 through 156.176.
      (2)   The use and placement of signs shall be subject to the regulations set forth in §§ 156.190 through 156.199.
      (3)   Required screening, buffering, and landscaping shall be provided in accordance with §§ 156.210 through 156.217.
      (4)   Temporary structures shall be subject to the regulations set forth in § 156.069.
      (5)   Fences shall be subject to the regulations set forth in §§ 156.210 through 156.217.
      (6)   No outdoor storage of any materials (usable or waste) shall be permitted in this zone.
      (7)   All business activities permitted in this zone shall be conducted within a completely enclosed building, with the exception of off-street parking and loading areas and outdoor dining facilities.
      (8)   Merchandise may be displayed on sidewalks in the HCB District in limited amounts for limited periods of time.
      (9)   A site plan, as regulated by §§ 156.295 through 156.307 shall be required for any multifamily, church, school, or government facility (including police and fire stations, public libraries, and post offices) permitted in this zone.
