(A) Definition. The HS District establishes commercial areas generally along the U.S. Highway 231 and Interstate 70 intersection. The character of the HS District is automobile intensive and is limited to those areas that may require a concentration of motorist services.
(B) Permitted uses.
(1) Police or fire station;
(2) Public or commercial parking lot or parking garage;
(3) Telephone exchange or public utility substation;
(4) Post office;
(5) Hotel or motel;
(6) Highway maintenance garage;
(7) Car wash;
(8) Automobile and motorcycle sales and service;
(9) RV and camper sales and service;
(10) Automobile rental and leasing service;
(11) Motor vehicle repair, provided that automobile storage areas are screened according to the provisions of § 156.215(A);
(12) Automotive parts and accessories sales;
(13) Service station, with or without repair, provided that the requirements found in § 90.42 are met;
(14) Drive-through restaurant;
(15) Roadside food sales stand;
(16) Wholesale produce terminal;
(17) Freestanding restaurants; and
(18) Retail businesses.
(C) Accessory uses.
(1) Uses listed below that are included within and entered from within any hotel or motel as a convenience to the guests thereof, provided that the accessory uses shall not exceed 10% of the gross floor area of the permitted uses in the building:
(a) Swimming pools;
(b) News dealers;
(c) Gift, craft, or souvenir shop;
(d) Coffee or refreshment stand;
(e) Restaurant;
(f) Ticket reservation facilities; and/or
(g) Visitor and tourist information services.
(2) Administrative offices that are incidental to the operation of the permitted use; and
(3) Automobile leasing and rental services may be permitted as an accessory use to automobile sales and services.
(D) Special exceptions.
(1) Farm equipment sales and service;
(2) Industry, light;
(3) Self-storage units (commercial);
(4) Communication relay tower, subject to the provisions of § 156.068;
(5) Wireless communication tower, subject to the provisions of § 156.068;
(6) Truck terminal;
(7) Health spa or fitness center;
(8) Bait sales;
(9) Boat or marine equipment and sales;
(10) Billiard room;
(11) Bowling alley;
(12) Dancing, aerobics, gymnastics studio;
(13) Outdoor commercial recreational enterprise;
(14) Private recreational development;
(15) Movie theater, indoor;
(16) Movie theater, drive-in; and
(17) Factory outlet store.
(E) Area and height regulations for permitted uses.
(1) Minimum lot size: 20,000 square feet;
(2) Minimum lot width: 100 feet;
(3) Minimum depth of front yard:
(a) The following minimum front yard depths apply:
1. Abutting U.S. Highway 231: 30 feet;
2. Abutting Interstate 70: 50 feet; and/or
3. Abutting intersecting roads: 30 feet.
(b) For double frontage and corner lots which have more than one yard abutting a street, minimum front yard depth requirement shall apply to each yard which abuts a street; and
(c) For a lot which does not abut a public street, the minimum depth of front yard shall be 25 feet, measured from the front lot line.
(4) Minimum depth of rear yard: 15 feet, except where the rear yard abuts a residential district, in which case the minimum rear yard depth shall be 40 feet;
(5) Minimum depth of side yard: ten feet, except where the lot line of a nonresidential use abuts a residential district, in which case the minimum side yard depth shall be 25 feet;
(6) Intensity: the total floor area shall not exceed 70% of the lot area; and
(7) Maximum building height: 60 feet, except that chimneys, cooling towers, elevator bulkheads, fire towers, water towers, transmission towers, or essential mechanical appurtenances may be erected to any height not prohibited by any other law. Buildings in excess of 60 feet in height may be approved as special exceptions, where the function of the building (e.g., certain hotels) may require a multistory building in order to be economically operated.
(F) Area and height regulations for accessory uses. Accessory uses shall be regulated by the provisions of § 156.067.
(G) Area and height regulations for special exceptions. All uses allowed by special exception shall be subject to the same development controls that apply to permitted uses. These regulations are set forth in division (E) above.
(H) Other development controls.
(4) Temporary structures shall be subject to the regulations set forth in § 156.069.
