4-9-4 LICENSE FEE.
   1.   New Massage Therapy Businesses in City.
      A.   The license fee for a massage therapy business in the City, as well as additional fees per employee, contractor, or individual providing therapy services at the business (“additional therapist fee”), shall be set by the license fee schedule approved by the Council, which license fee schedule may be modified from time to time with the approval of Council. The license fee and additional therapist fee shall be paid when the application is filed and when a therapist is added to the business.
      B.   The license, if granted, and not revoked or suspended, shall be valid so long as the business does not change more than 51 percent of the ownership, business name, or the service provided. An annual review shall be initiated by the Clerk, with assistance from the Police Department, to confirm business ownership, business name, service(s) provided and accurate and up-to-date State licenses for the employees, contractors, or agents performing massage therapy.
   2.   Existing Massage Therapy Businesses Within the City.
      A.   For a massage therapy business applying for licensure in the initial year of this chapter’s effective date (July 1, 2018, through June 30, 2019) the licensing fee identified in Subsection 1 of this section is waived. If an application properly submitted during the first year of this chapter is approved, and the massage therapy business remains in continuous operation, renewal fees for a massage therapy business license will be waived. A massage therapy business grandfathered in under this section will not be required to pay for the additional therapist fee for each additional employee, contractor, agent, or therapist not included in their original application.
      B.   An annual review shall be initiated by the Clerk, with assistance from the Police Department, to confirm business ownership, business name, service(s) provided and accurate and up-to-date State licenses for the employees, contractors, or agents performing massage therapy.
   3.   A separate license shall be obtained for each place of business. The licensee shall display the license in a prominent place in the licensed business at all times.
   4.   During the 12-month licensed period, the massage therapy businesses will be required to notify the Clerk of changes in massage therapist staffing, contracting, therapists, ownership, or business management.
