12-1-4: PLANNING AND ZONING BOARD RESPONSIBILITY, APPROVAL:
   A.   Responsibility: The primary responsibility for the adoption, amendment, interpretation and administration of this title shall be that of the planning and zoning board. It is the intent of the planning and zoning board that the public interest be protected by a thorough review of all proposed plats without undue delay to developers. (1991 Code § 20-3)
   B.   Approval: The approval of the planning and zoning board, by majority vote of the full board, or the refusal to approve, shall take place within forty five (45) days from and after the submission of the plat for final approval, unless the developer agrees in writing to an extension of this time period; otherwise, such plat shall be deemed to have been approved, and the certificate of the planning and zoning board, as to the date of the submission of the plat for approval and as to the failure to take action thereon within such time, shall be sufficient in lieu of the written endorsement or evidence of approval herein required. The grounds for refusal of any plat submitted or regulations violated by the plat shall be stated upon the record of the planning and zoning board. (1991 Code § 20-11)
