A. Entering Of Order: Prior to the trial of a case, the judge may enter an order with respect to such case providing for one or both of the following:
1. The defendant will not be imprisoned if he is convicted.
2. A maximum fine that can be assessed if the defendant is convicted.
B. Sentencing: If such an order is entered, sentencing must be in accordance with such order.
C. Right To Order Imprisonment: This section does not restrict the right of the judge to order imprisonment of a financially able person for failure to pay a fine. (1991 Code § 12-12)
