8-2-1: TRIMMING REQUIRED; NOTICE; NONCOMPLIANCE:
   A.   Property Owner Responsibility: It is the duty of every person who is the owner of, or who as agent has the control of, any real property or premises situated within the limits of the city, abutting on any street, alley, sidewalk, or other public place, upon being notified so to do, to trim and keep trimmed all trees on such real property and premises and the parking contiguous and adjacent thereto, the branches of which overhang any portion of such streets, alleys, sidewalks or other public places in such manner that the lowermost branches thereof shall be at least thirteen feet six inches (13'6") above the level of the portion of such streets, alleys, sidewalks or other places so overhung by such branches.    B.   Failure To Comply: If the owner or agent having control of any real property or premises coming under this chapter, after having been notified so to do and after the lapse of a reasonable time thereafter, not to exceed ten (10) days, shall fail, neglect or refuse to comply with the requirements of this chapter, it shall be the duty of the code enforcement officer to cause the work to be done at the expense of the owner of such real property and premises, and any expense incurred in the doing of the same shall be assessed against such real property and premises and certified to the county treasurer for collection as are other taxes.
