6-2-11: PARKING VIOLATIONS, FINES:
   (A)   Two Hour Parking; Parking Meters:
      1.   Parking Meters: Any person who shall fail to activate a parking meter as required, shall be fined five dollars ($5.00), if such fine is paid within forty eight (48) hours; and if said fine is not paid within forty eight (48) hours, then the fine shall be ten dollars ($10.00), and shall remain so until thirty (30) days after mailing a notice by the city to the violator. At the end of the aforesaid thirty (30) day period, the fine shall increase to forty dollars ($40.00).
      2.   Two Hour Parking: Any person who shall violate the two (2) hour parking limit shall be fined five dollars ($5.00), if such fine is paid within forty eight (48) hours; and if said fine is not paid within forty eight (48) hours, then the fine shall be ten dollars ($10.00), and shall remain so until thirty (30) days after mailing a notice by the city to the violator. At the end of the aforesaid thirty (30) day period, the fine shall increase to forty dollars ($40.00).
   (B)   Parking On Sidewalk, Other Prohibited Places: Any person who shall violate any section prohibiting parking on a sidewalk or parkway, or shall park with the left front driver's side of a vehicle next to the curb, except on one-way streets, shall be fined five dollars ($5.00), if such fine is paid within forty eight (48) hours; and if said fine is not paid within forty eight (48) hours, then the fine shall be ten dollars ($10.00) and remain so until thirty (30) days after mailing of a notice by the city to the violator. At the end of the aforesaid thirty (30) day period, the fine shall increase to forty dollars ($40.00).
   (C)   Restricted Areas, Time Limit Parking: Any person who shall violate any section prohibiting parking of a vehicle in a designated area, including reserved spaces or restricting the length of time a vehicle may there be parked, shall be fined five dollars ($5.00), if such fine is paid within forty eight (48) hours; and if said fine is not paid within forty eight (48) hours, then the fine shall be ten dollars ($10.00) and shall remain so until thirty (30) days after mailing of a notice by the city to the violator. At the end of the aforesaid thirty (30) day period, the fine shall be increased to forty dollars ($40.00). (Ord. 741, 8-3-1998)
   (D)   Overnight Parking Of Semitractors And Semitrailers: Any person who shall park in violation of subsection 6-2-6(B) of this chapter, or any person who shall park a semitractor, tractor or detached semitrailer on any street, shoulder, or right of way shall be fined twenty five dollars ($25.00), if such fine is paid within forty eight (48) hours; and if said fine is not paid within forty eight (48) hours, then the fine shall be fifty dollars ($50.00) and remain so until thirty (30) days after mailing of a notice by the city to the violator. At the end of the aforesaid thirty (30) day period, the fine shall increase to one hundred dollars ($100.00). (Ord. 740, 7-6-1998)
   (E)   Failure To Pay Fine, Court: At the end of the thirty (30) day period provided above, any violator may be taken to court and the fine established by the court, upon conviction, between the limits of forty dollars ($40.00) and five hundred dollars ($500.00) for each offense.    (F)   Snow Emergency Routes: Any person who shall violate section 6-2-9 of this chapter establishing snow emergency routes shall be fined twenty five dollars ($25.00).
   (G)   Exceptions: The above subsections shall not apply to persons parking a vehicle so as to obstruct the entrance or exit of any place where the police or fire department apparatus or other emergency equipment is kept or housed, or so as to block an emergency entrance to a hospital. Nor shall this subsection apply to any person parking a vehicle so as to entirely obstruct traffic in any street or alley, or parking in such a way as to reduce traffic on an arterial street to one-way traffic only; nor to any person who refuses to move a vehicle he illegally parked at the request of any member of the police department.    (H)   Presumption Of Liability: Proof of registration of a motor vehicle and proof of a violation of this chapter shall be construed as prima facie proof that the registered owner of such motor vehicle was the user or operator thereof at the time of the violation charge.
   (I)   Violations, Issue Tickets: It shall be the duty of a duly appointed agent of the city council to issue tickets to all persons who violate the provisions of this chapter. Such tickets may be delivered to the violator personally, or may be affixed to the vehicle of the violator. The said ticket shall direct the violator to appear and present such ticket at a designated place on or before a certain hour designated thereon. Nothing in this subsection shall be construed to abridge the power of the police officer to arrest any violator and take him into custody. (Ord. 208, 8-17-1981)
   (J)   Chalk Lines: Any person who shall remove chalk lines or other markings from tires used to establish violations of this chapter shall be fined twenty five dollars ($25.00), if such fine is paid within forty eight (48) hours; and if such fine is not paid within forty eight (48) hours, then the fine shall be fifty dollars ($50.00) and remain so until thirty (30) days after mailing of the notice by the city to the violator. At the end of the aforesaid thirty (30) day period, the fine shall increase to one hundred dollars ($100.00). (Ord. 737, 6-29-1998)
