4-3-1: NUISANCES DECLARED:
   (A)   Weeds: Any weeds such as jimson, goldenrod, burdock, ragweed, thistle, cockleburr or other weeds of a like kind, found growing in any lot or tract of land in the city are hereby declared to be a nuisance, and it shall be unlawful to permit any such weeds to grow or remain in any such place. (1968 Code, sec. 52-101)
   (B)   Barberry Bushes: lt shall be a nuisance and unlawful to plant or permit the growth of the bush or the species of tall, common or European barberry, further known as Berberia vulgaris or its horticultural varieties within the city. (1968 Code, sec. 52-103)
   (C)   Brush, Shrubbery And Grass On City Right-Of-Way: It shall be a nuisance and unlawful to place or allow to be placed on right-of-way adjacent to an owner or occupant's property any brush or shrubbery except between the third Monday in March and the third Monday in November and grass except between the third Monday in March and November 30, and with the following conditions and requirements:
      1.   Brush And Shrubbery: No earlier than seven (7) days prior to the third Monday of the month, an owner or occupant of property may place one pile of brush and/or shrubbery on the right-of-way adjacent to the owner or occupant's property provided:
         (a)   The brush and shrubbery is placed in a pile with dimensions no larger than four (4') feet in width, eight (8') feet in length, and four (4') feet in height;
         (b)   The brush and shrubbery shall not be placed on the sidewalk or paved portion of any City right-of-way.
         (c)   Placement of brush and shrubbery is limited to one pile per month, regardless of how many dwelling units are on the property.
The Superintendent of Public Works can suspend the requirements of this Section 4-3-1 (C)(1) to allow removal of Brush and Shrubbery resulting from a storm, ice, or other natural event.
      2.   Grass, Hedge Clippings And Leaves: An owner or occupant of property may place grass, hedge clippings and leaves on the right-of-way adjacent to the owner or occupant's property provided:
         (a)   Grass, hedge clippings and leaves must be properly packaged in biodegradable paper bags.
         (b)   Grass, hedge clipping and leaf bags shall not weigh more than thirty (30) pounds each.
         (c)   Grass, hedge clipping and leaf bags shall not include sod, trees, stumps, dirt, stones, garbage, animal waste, or construction wastes.
      3.   Leaf Pickup: Notwithstanding the requirements of Section 4-3-1 (C)(2), from October 1st through November 30th, leaves may be raked in neat rows to the terrace on City right-of-way. Leaves shall not be placed upon the sidewalk or paved portion of a street.
      4.   Alley And Alley Right-Of-Way: No brush, shrubbery, grass clippings, hedge clippings, or leaves shall be placed on City alleys or alley right-of-way unless the property adjacent to said alley or alley right-of-way does not have access to a City street or street right-of-way.
