3-3-20: PROHIBITIONS OF PERSONS UNDER THE AGE OF TWENTY ONE YEARS:
   (A)   Sales To Persons Under The Age Of Twenty One Years:
      1.   Sales Prohibited: No licensee, and no agent of any licensee, shall sell, give or deliver any alcoholic liquor to any person under the age of twenty one (21) years.
      2.   Secondary Transfer Prohibited: No person, after purchasing or otherwise obtaining alcoholic liquor, shall sell, give or deliver such alcoholic liquor to any person under the age of twenty one (21) years. (Ord. 905, 10-7-2002; Ord. 912, 11-4-2002)
      3.   Identification Required:
         (a)   Before making a sale or delivery of alcoholic liquor, a licensee or any agent of a licensee shall demand adequate written evidence of age. (Ord. 1123, 4-21-2008)
         (b)   For the purpose of preventing a violation of this subsection, any licensee, and any agent of a licensee, may refuse to sell alcoholic liquor to any individual who is unable to produce adequate written evidence of identity and age.
      4.   Warning Required: Every licensee shall display at all times, in a prominent and conspicuous place located within the licensed premises, a written warning reading substantially as follows and shall be no less than eight and one-half inches by eleven inches (81/2" x 11") in size with type no smaller than thirty six (36) points:
Warning to persons under 21: You are subject to a fine under the City of Clinton, Illinois Municipal Code, if you purchase alcoholic liquor or if you misrepresent your age for the purpose of purchasing or obtaining alcoholic liquor. Fine amounts are $100.00 for a first violation, $150.00 for a second violation, and $200.00 for any violation after two violations.
   (B)   Consumption, Purchase And Possession Prohibited: No person under the age of twenty one (21) years shall consume alcoholic liquor, purchase alcoholic liquor, accept a gift of alcoholic liquor, or have alcoholic liquor in his or her possession.
   (C)   False Identification Prohibited:
      1.   Misrepresentation Prohibited: It shall be unlawful for any person under the age of twenty one (21) years to misrepresent his or her age for the purpose of purchasing or obtaining alcoholic liquor. It shall be unlawful for any person under the age of twenty one (21) years to present or offer to any licensee, or to the agent of any licensee, any written, printed, or photostatic evidence of identity or age that is false, fraudulent or is not his or her own for the purpose of ordering, purchasing, attempting to purchase, or otherwise procuring or attempting to procure alcoholic liquor. It shall be unlawful for any person under the age of twenty one (21) years to have in his or her possession any false or fraudulent written, printed, or photostatic evidence of identity or age.
      2.   Transfer And Alteration Of Identification Prohibited: It shall be unlawful for any person under the age of twenty one (21) years to transfer, alter or deface any written, printed or photostatic evidence of identity or age or to obtain any written, printed or photostatic evidence of identity or age by means of false or fraudulent information.
      3.   Conveyance Of False Identification Prohibited: It shall be unlawful for any person to sell, give or furnish to any other person, any false or fraudulent written, printed or photostatic evidence of identity or age. It shall be unlawful for any person to sell, give, or furnish to any other person, any evidence of identity or age with the knowledge or intent that such evidence will be used to circumvent the provisions of this chapter.
   (D)   Persons Under The Age Of Twenty One Years On The Licensed Premises:
      1.   Class A Licensee: It shall be unlawful for any licensee holding a Class A license, or agent of such licensee, to permit any person under the age of twenty one (21) years to be or remain in any room or compartment within the room or place in which the licensed premises is located; provided, however, that this subsection (D)1 shall not apply to:
         (a)   Any person under the age of twenty one (21) years who is on or in a segregated portion of the licensed premises during special events of a nature where persons under the age of twenty one (21) years would reasonably be expected to be in attendance, provided, however, that in such situations, persons under the age of eighteen (18) years shall be accompanied by his or her parent or legal guardian;
         (b)   For purposes of this subsection (D)1, the term "segregated area" shall be a room or compartment within the licensed premises separated by a floor to ceiling partition separating said area from that portion of the licensed premises containing the bar. For purposes of this subsection (D)1, the term "bar" shall mean a counter designed with seating or standing areas for three (3) or more persons, attended by a person who regularly delivers alcoholic liquor to patrons, for consumption at the counter. The local liquor control commissioner shall specifically approve any segregated area of the class A licensed premises to be utilized by persons under the age of twenty one (21) years.
      2.   Class BG Licensee: It shall be unlawful for any licensee holding a class BG license, or agent of such licensee, to permit any person under the age of twenty one (21) years to be or remain in any room or compartment within the room or place in which the licensed premises is located; provided, however, that this subsection (D)2 shall not apply to: (Ord. 905, 10-7-2002; Ord. 912, 11-4-2002)
         (a)   Any person under the age of twenty one (21) years who is on or in the licensed premises during the hours of seven o'clock (7:00) A.M. to nine o'clock (9:00) P.M., Monday through Saturday, provided, however, that such persons under the age of eighteen (18) years shall be accompanied by his or her parent or legal guardian.       3.   Class C Licensee: It shall be unlawful for any licensee holding a class C license, or agent of such licensee, to permit any person under the age of twenty one (21) years to be or remain in any room or compartment within the room or place in which the licensed premises is located; provided, however, that this subsection (D)3 shall not apply to:
         (a)   Any person under the age of twenty one (21) years who is on or in the licensed premises during special events of a nature where persons under the age of twenty one (21) years would reasonably be expected to be in attendance, provided, however, that in such situations, persons under the age of eighteen (18) years shall be accompanied by his or her parent or legal guardian;
         (b)   Any person under the age of twenty one (21) years who is on or in the licensed premises at any times that would not be subject to the provisions of subsection (D)3(a) of this section, provided, however, that such person under the age of twenty one (21) years shall be accompanied by his or her parent or legal guardian and shall not remain on the premises past nine o'clock (9:00) P.M.;
         (c)   Employees of licensee as specified in section 3-3-17 of this chapter;
         (d)   Any person under the age of twenty one (21) years who is on or in the licensed premises during any event being held by a nationally or internationally recognized service club.
      4.   Notice Of Special Events: Any licensee holding a class A license or class C license that will be conducting a special event where persons under the age of twenty one (21) years may be on the premises, shall notify the chief of police at least seven (7) days in advance of said special event, which said notice will describe the special event, give the date and time of the special event, and give an approximate number of persons attending said special event.
   (E)   Persons Under The Age Of Twenty One Years At Bar: No person under the age of twenty one (21) years shall be allowed to sit or stand at the bar of any licensed premises, except in a class C licensed premises or a bowling center when ordering food or nonalcoholic beverage items at the area of the bar designated solely for said purpose by persons under the age of twenty one (21) years. For purposes of this subsection, the term "bar" shall mean a counter, designed with seating or standing areas for three (3) or more persons, attended by a person who regularly delivers alcoholic liquor to patrons, for consumption at such counter. The local liquor control commissioner shall specifically approve any segregated area of a bar to be utilized by persons under the age of twenty one (21) years for the purpose of nonalcoholic beverages and food items.
   (F)   Parental Responsibility: It shall be unlawful for any parent or guardian to intentionally or knowingly permit any person under the age of twenty one (21) years for whom the parent or guardian is responsible, to violate any provision of this section.
