§ 158.02 DEFINITIONS.
   For the purposes of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ALLEY. A permanent serviceway providing a secondary means of access to abutting lands.
   ARTERIAL STREETS. Those streets designated in the street plan for large volumes of traffic movement. Certain arterial streets may be classified as business streets to serve congested business sections, and others as limited access highways to which entrances and exits are provided only at controlled intersections, which access is denied to abutting properties.
   BLOCK. A unit of property lying between the two nearest intersecting and intercepting streets or between the nearest intersecting and intercepting streets or railroad right-of-way, waterway or other definite barrier.
   BLOCK FRONTAGE. Property abutting on one side of a street, and lying between the two nearest intersecting or intercepting streets or railroad right-of-way, waterway or other definite barrier.
   BUILDING SETBACK LINE. A line on a plat between which line and a street right-of-way no building or structure may be erected.
   CIRCLE DRIVE. A residential street of a closed circular shape, which has one entrance open to traffic and intersects or intercepts no street other than the entrance.
   COMMISSION. The City Plan Commission.
   COMPREHENSIVE PLAN. The complete plan, or any of its parts, for the development of the city, prepared by the Commission and adopted in accordance with state law.
   CUL-DE-SAC, COURT or DEAD END STREET. A residential street having one end open to traffic and being permanently terminated by a vehicle turnaround.
   EASEMENT. A grant by the property owner of the use, for a specific purpose, of a strip of land by the general public, utilities, a corporation or a certain person or persons.
   FEEDER STREETS. Those designated as important streets to facilitate the collection of traffic from residential streets, to permit circulation within neighborhood areas and to provide convenient ways for traffic to reach arterial streets.
   FIFTY-YEAR STORM. Five and six-tenths inches of rain falling in a 24-hour period.
   FIVE-YEAR STORM. Six and three-tenths inches of rain falling in a 24-hour period.
   LOOP. A residential street that begins and ends at two spaced points on the same street and which intersects and intercepts no other street.
   LOT. A portion of a subdivision or other parcel of land intended as a unit for transfer of ownership or development.
   MAJOR ARTERIAL STREETS. Streets which are designed and intended to move large volumes of vehicles between cities or parts of the city.
   MINOR ARTERIAL STREETS. Streets which provide a function similar to the major arterial, but are primarily intra-city in nature, and operate at lower speeds than major arterials.
   ONE HUNDRED-YEAR STORM. Seven and three-tenths inches of rain falling in a 24-hour period.
   PLACE or PRIVATE DRIVE. An open, unoccupied, officially designated, privately owned space, other than a street or alley, permanently reserved for use as the principal means of access to one or more abutting properties as specifically authorized under this chapter. For the purposes of this chapter, a PLACE or PRIVATE DRIVE shall be subject to the same requirements, conditions, restrictions and connotations as streets. For single-family and two-family dwellings, not more than three lots or three principal structures may be served by a PRIVATE DRIVE.
   PLAT. A map or chart indicating the subdivision or resubdivision of land, intended to be filed for record.
   PRIVATE SANITARY SEWER SYSTEM. A sewer owned, controlled and maintained by property owners, a subdivider or a duly constituted homeowner association.
   PRIVATE SEWAGE TREATMENT AND DISPOSAL SYSTEM. All equipment and materials needed to properly treat and dispose of sewage from a single residential, commercial or industrial use.
   PRIVATE WATER WELL SYSTEM. Any excavation that is drilled, bored, driven or dug in the earth to provide a source of water for a single residential, commercial or industrial use.
   PUBLIC SANITARY SEWER OUTLET. A public sanitary sewerage system which conveys sewage to a public wastewater treatment facility.
   PUBLIC SANITARY SEWER SYSTEM. A sewer owned, controlled, maintained and subject to the jurisdiction of the city.
   PUBLIC WATER SUPPLY. Those water systems owned, controlled and maintained in accordance with the franchise between the provider and the city.
   QUASI-PUBLIC SEWAGE TREATMENT AND DISPOSAL SYSTEM. All equipment and materials needed to properly treat and dispose of sewage from more than one residential, commercial or industrial user, and other than a public sanitary sewer system.
   QUASI-PUBLIC WATER WELL SYSTEM. Any excavation that is drilled, bored, driven or dug in the earth to provide a source of water for more than one residential, commercial or industrial user, and other than a public water supply.
   REPLAT. A subdivision or plat, the site of which has heretofore been platted or subdivided with lots of parcels of land. It may include all or any part of a previous subdivision or plat.
   RESIDENTIAL STREETS. Streets which are to provide access to individual properties.
   STREET. A right-of-way, dedicated to and accepted for the public use, which affords the principal means of access to abutting property. A STREET may be designated as a highway, thoroughfare, parkway, boulevard, road, avenue, lane, drive, place or other appropriate name. A STREET may also be identified according to type of use.
   STREET PLAN. The part of the comprehensive plan which sets forth the location, alignment, dimensions, identification and classification of existing and proposed public streets, highways and other thoroughfares.
   SUBDIVIDERS. Any person, individual, firm, partnership, association, corporation, estate, trust or any other group including any agent thereof or combination acting as a unit, engaged in developing or improving a tract of land which complies with the definition of a “subdivision” as defined herein.
   SUBDIVISION. For the purpose of this chapter, a SUBDIVISION of land is either:
      (1)   The division of land into three or more tracts, sites or parcels;
      (2)   Establishment or dedication of a road, highway, street, alley, place or private drive through a tract of land regardless of area;
      (3)   Resubdivisions or replats of land heretofore divided or platted into lots, sites or parcels; however, the sale or exchange of small parcels of land to or between adjoining property owners, where the sale or exchange does not create additional lots, nor place the lots in nonconformance with the provisions of the zoning regulations or this chapter, shall not be considered as a SUBDIVISION of land; or
      (4)   The improvement of one or more parcels of land for residential, commercial or industrial structures or groups of structures involving the allocation of land for common use by owners, occupants or leaseholders.
   TEN-YEAR STORM. Four and five-tenths inches of rain falling in a 24-hour period.
   TWENTY-FIVE-YEAR STORM. Five and five-tenths inches of rain falling in a 24-hour period.
   TWO-YEAR STORM. Three and one-tenth inches of rain falling in a 24-hour period.
