§ 122.05 DENIAL, SUSPENSION OR REVOCATION OF PERMIT.
   (A)   The City Clerk may, upon good cause, deny issuance or renewal of a permit or suspend or revoke any permit issued under this chapter for a period not to exceed one year for any of the following:
      (1)   Violation of any federal, state, or local law;
      (2)   Misrepresentation of any material fact in the application for a permit;
      (3)   Failure to cooperate with law enforcement;
      (4)   Failure to comply with any and all applicable provisions of the city’s zoning ordinance as stated in chapter 159 of this code of ordinances; or
      (5)   The permittee, owner, manager, partner, corporate officer, or director has been convicted of a crime involving robbery, burglary, theft, forgery, fraud, or deceptive practices, the possession, manufacture, or delivery of a controlled substance, possession with intent to manufacture or deliver a controlled substance, possession of drug paraphernalia, or nonpayment of excise taxes for a controlled substance, nonpayment of other taxes, or demonstrated insolvency.
   (B)   Any permittee whose permit is suspended may not, during said suspension, hold any other permit under this chapter.
   (C)   No new permit will be issued to the spouse, relative within the first degree of consanguinity as defined by the Iowa Code, or any person holding a financial interest in the permitted premises during the period the permit has been suspended.
   (D)   Any permittee whose permit is revoked may not apply for any permit under this chapter for a period of one year from the date of revocation.
   (E)   No new permit under this chapter will be issued to the spouse, relative within the first degree of consanguinity as defined by the Iowa Code, or any person holding a financial interest in the permitted premises for one year from the date of revocation.
   (F)   The City Clerk will cause to be issued a notice that said permit is suspended or revoked and set forth the reason(s) for the suspension or revocation therein. The notice must be sent to the permittee by certified United States mail to the registered business address on file with the city clerk or by personal service as provided by Iowa law.
   (G)   A written notice of appeal to the City Council from a decision of the City Clerk must be filed with the City Clerk by the permittee within ten days from the receipt of the notice of suspension or revocation.
