§ 52.09  CITY RESERVOIRS.
   (A)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      IN-TAKE FACILITY. The pumping site within the on-channel reservoir, including the concrete structures and associated pumping equipment.
      OFF-CHANNEL RESERVOIR. The surface lake and drainage area located south and west of C.R. 4290 in the county, comprising the impoundment reservoir for the city’s water supply system.
      ON-CHANNEL RESERVOIR. To the impoundment on the North Bosque River at Riverside Drive in the city used for the purpose of retaining and holding water for transfer to the Surface Lake.

   (B)   Restricted activities.
      (1)   The following are prohibited within 1,000 feet of the in-take facility in accordance with paragraph 290.41(e)(2)(b) of the Rules and Regulations for Public Water Systems, being Tex. Administrative Code Ch. 290, State Natural Resource Conservation Commission: boat launching ramps; marina; or floating fishing piers accessible by the public.
      (2)   The following are prohibited within 200 feet of the in-take facility in accordance with paragraph 290.41(e)(2)(c) of the Rules and Regulations for Public Water Systems, being Tex. Administrative Code Ch. 290, State Natural Resource Conservation Commission: all recreational activities; and trespassing.
      (3)   No unauthorized personnel are permitted at the off-channel reservoir at any time.
      (4)   Release of any hazardous or potentially hazardous materials is prohibited on or within the natural drainage area of the on-channel reservoir and the off-channel reservoir.
