§ 111.01 CARNIVALS, CIRCUSES AND SIMILAR SHOWS.
   (A)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   CARNIVAL.  A collection of shows under canvas, ferris wheels, merry-go-rounds, doll racks, knife racks, and the usual paraphernalia of street carnivals.
   CIRCUS. Any wild animal show under canvas, acrobatic exhibitions under canvas, gymnastic exhibitions under canvas, ring performance under canvas, and the usual paraphernalia and performances of the ring circus. The term “circus” shall not only be construed to mean and embrace every show or exhibition commonly known as a circus, but shall include menageries and any combination of circus and menagerie.
   (B)   Exception. This section shall not apply, however, to any charitable organization or local theaters that have for their purpose educational or charitable benefits or any dramatic performances for church purposes.
   (C)   Permit. It shall be unlawful for any person to erect, locate, set up, conduct or operate a carnival, collection of shows under canvas, or a circus within the corporate limits of the city without a permit so to do issued by the City Manager.
   (D)   Tax on street parades.
      (1)   Every circus and traveling show which shall make a public parade on any of the streets of the city shall be and the same is required to pay a special tax for said privilege as follows:
         (a)   For each parade made by a circus, the sum of $50.
         (b)   For each parade made by any other show, the sum of $5.
      (2)   Such taxes shall be paid before such respective parades are made, and the Chief of Police is instructed and authorized to prevent such parades until such taxes are paid. The provisions of this division (D) shall not apply to parades of circuses where every vehicle used is motorized and equipped with rubber tires.
   (E)   Violation of section. The proprietor, manager or any other person of any of such shows violating any of the provisions of this section shall be deemed guilty of a misdemeanor.
