§ 96.58 OFFENSE.
   (A)   A person commits an offense if the person maintains a public nuisance described by § 96.45 of this chapter. Each day that a person maintains the public nuisance shall be a separate offense.
   (B)   An offense under this section is a Class C misdemeanor punishable by a fine as set forth in § 10.99 of this code.
   (C)   The court shall order abatement and removal of the nuisance upon conviction for an offense under this section.
