§ 91.039 DISPOSITION OF DISEASED ANIMALS.
   Any animal taken into custody and held at the impounding facility by the animal services officer, except animals which have inflicted human bites during the preceding ten days, that are visibly affected with any sign of communicable disease other than rabies may, instead of being impounded, be humanely destroyed, provided that:
   (A)   Any animal which has inflicted any human bite during the preceding ten days have its head removed and submitted to the laboratory for rabies examination.
   (B)   Any animal exhibiting symptoms of rabies must be handled in a manner prescribed by the local health authority.
