§ 50.03 GARBAGE TO BE COLLECTED BY CITY SANITARY DEPARTMENT; PRIVATE COLLECTION FOR HIRE PROHIBITED.
   (A)   Garbage collection service is provided by the city and may use at its discretion a manual or semi-automated collection system in areas where automated collection vehicles cannot safely or efficiently operate. It shall be mandatory for all occupants, persons in possession, charge, or control of places or premises in the city in or from which garbage is created, accumulated or produced, to exclusively use the city garbage collection service; provided, however, that there may be joint or multiple use of garbage containers with approval from the City Sanitation Department. The City Sanitation Department or its designated authorized representatives shall make periodic garbage pick-ups throughout the city utilizing plastic garbage carts that are provided or approved by the city.
   (B)   It shall be unlawful for any person, firm or corporation, other than the authorized representatives or sanitation employees of the city, to collect, remove, or dispose of garbage in the city or to rent or lease garbage containers to any individual or firm located in the city; provided, however, that the provision of this section prohibiting private garbage hauling shall not apply to those persons or firms whose job or occupation incidentally include the occasional removal of garbage or debris from a location in the city. This exception shall pertain to persons or firms employed at such jobs as house cleaning, yard work, or premises clean-up; however, such persons or firms must dispose of any collected garbage at the city landfill or city incinerator upon payment of the established fee.
   (C)   Carts shall be provided by the city and issued to an address. Carts shall not be removed from that premises. (Only approved carts will be serviced). The carts shall be the property of the city and must not be painted, marked, abused, mutilated, altered or modified in any way. Abuse and damage to a cart by a customer shall result in an assessment equal to the replacement cost of cart and /or time and materials involved in repair of cart. Examples of abuse include but are not limited to over loading the cart beyond the rated weight capacity; fire damage caused by hot coals and or ashes; painting or marking the cart in any manner or failing to follow the proper care and use instructions for the cart.
