13-5-4: FLOODWAYS:
Located within areas of special flood hazard established in section 13-4-2 of this title are areas designated as floodways. Since the floodway is an extremely hazardous area due to the velocity of floodwaters which carry debris, potential projectiles and erosion potential, the following provisions apply:
   A.   Prohibit Encroachment: Prohibit encroachment, including fill, new construction, substantial improvements and other development unless certification by a registered professional engineer or architect is provided demonstrating that encroachments shall not result in any increase in flood levels during the occurrence of the base flood discharge.
   B.   Dumping Permit Required: It is unlawful for any person to dump or place any garbage, trees, brush, dirt, refuse, rubbish or other waste material in the bed or channel or any natural stream, or in any watercourse, ravine or gulley which usually carries storm water or spring runoff waters so as in any way to obstruct or interfere with the flow of such waters without first obtaining a permit to do so from the planning commission.
