§ 99.01 PROHIBITING CERTAIN ANIMAL ESTABLISHMENTS.
   (A)   The creation, establishment and operation for commercial or private use of any barns, feedlots, farms, pens, stables, slaughterhouses or stockyards, whether for feeding, storing, shipment or slaughtering of any animal or fowl, including but not limited to cattle, goats, horses, pigs, poultry or sheep, within a 1-mile radius of the municipal boundaries of the Town of Clayton, New Mexico, is hereby prohibited and declared a public nuisance as being detrimental and offensive to the public health, prosperity, order, comfort, convenience and welfare of the town and its inhabitants.
   (B)   The enlargement of any existing, similar facilities described in division (A) above, located within a 1-mile radius of the municipal boundaries of the Town of Clayton, New Mexico, whether by additions for the existing physical facilities or by increases in the number of animals or fowl over the present normal capacity, is likewise prohibited and declared a public nuisance.
