§ 96.05 NUISANCES GENERALLY.
   (A)   If any person, firm, company or corporation shall permit or suffer any ground, building, ditch or other premises within the town, owned or occupied by him, her or it, or of which he, she or it shall be the agent having charge of the same, to become or be offensive, nauseous, hurtful or dangerous to the neighborhood or travelers by reason of stagnant water, dead animals or from any cause or causes, he, she or it shall be punished as hereinafter provided.
   (B)   If any person shall suffer any animal belonging to him or her or in his or her charge, which may die of disease, or otherwise, to be in or upon any street, alley or other grounds or place within the town limits, public or private, for the space of 24 hours after the same shall have died, he or she shall be punished as hereinafter provided.
   (C)   If any person shall allow to flow from any house, shop, factory, stable, slaughterhouse or place, any foul or nauseous liquor or substance, of any kind whatsoever, into or upon any adjacent ground or lot, or into any street, alley or ditch within the town so as to be offensive, nauseous, hurtful or dangerous; and any person who shall deposit in any such place any filth, litter or refuse or carcass or thing so as to be offensive, nauseous, hurtful or dangerous to any portion of the inhabitants of the town, he or she shall be punished as hereafter provided.
   (D)   Except as hereinafter provided, it shall be and hereby is declared a nuisance and misdemeanor to keep, operate, maintain or use a slaughterhouse or to slaughter meat cattle, sheep or swine within the limits of the town; provided, however, there is excluded, from this prohibition and it shall be lawful to keep, operate, maintain and use slaughterhouses and to slaughter meat cattle, sheep and swine in that area of the town lying east of the right-of-way of Colorado & Southern Railway Company and north of the right-of-way of the Elkhart & Santa Fe Railroad Company, upon condition that the slaughterhouses be kept in a sanitary condition, that no offal or waste matter therefrom be permitted to accumulate therein or thereby and that no offensive odors emanate therefrom. Violation of the conditions or any of them shall render the slaughterhouses a nuisance, subject to abatement as such, and their keeping, operation maintenance or use a misdemeanor punishable as hereinafter provided.
