§ 111.36 CHANNELS, NEW DEVELOPMENTS, AND ACCESS UTILIZATION.
   The town shall have the authority to order a public hearing from time to time on the provision of channel capacity for public bandwidth on the network. If after a hearing, the town determines:
   (A)   That there exists a reasonable demand for additional bandwidth; and
   (B)   That provisions have been made to allow the company a fair rate of return on its investments, the town shall order the company to provide such additional capacity within a reasonable amount of time. If the town finds that additional public bandwidth is desirable, the company shall within three months from receipt of written notice from the town made additional bandwidth available.
