§ 111.14 OPERATIONAL STANDARDS AND PERFORMANCE MONITORING.
   (A)   The grantee shall put, keep, and maintain all parts of the CATV system in good condition throughout the entire franchise period.
      (1)   Not later than 90 days after a substantial new or substantially rebuilt portion of the system is made available for service to subscribers, technical performance tests shall be conducted by the grantee to demonstrate full compliance with the technical standards required by the FCC. These tests shall be performed by or under the supervision of a qualified registered professional engineer or an engineer with proper training and experience. A copy of the report shall be submitted to the town describing test results, instrumentation, calibration and test procedures, and the qualifications of the engineer responsible for the tests.
      (2)   At any time after commencement of service to subscribers, the town may require additional tests, full or partial repeat tests, different test procedures, or tests involving a specific subscriber's terminal. Requests for additional tests will be made on the basis of complaints received or other evidence indicating an unresolved controversy or significant noncompliance, and the tests will be limited to the particular matter in controversy. The town will endeavor to so arrange its request for these special tests so as to minimize hardship or inconvenience to the grantee or to the subscriber.
   (B)   The grantee shall render efficient service, make repairs promptly, and interrupt service only for good cause and for the shortest time possible. These interruptions, insofar as possible, shall be preceded by notice and shall occur during periods of minimum system use.
      (1)   Service repair response time to a subscriber shall not exceed 24 hours except in circumstances beyond the reasonable control of the grantee.
      (2)   The grantee may interrupt system service after 7:00 a.m. and before l:00 a.m. only with good cause and for the shortest time possible, and except in emergency situations, only after publishing notice of service interruption at least 24 hours in advance of the service interruption. Service may be interrupted between l:00 a.m. and 7:00 a.m. for routine testing, maintenance, and repair, without notification, any night except Friday, Saturday, or Sunday, or the night preceding a holiday.
   (C)   The grantee shall not allow its cable or other operations to interfere with television reception of persons not served by grantee, nor shall the system interfere with, obstruct, or hinder in any manner the operation of the various utilities serving the residents within the confines of the town.
   (D)   The grantee shall continue through the terms of the franchise to maintain the technical standards and quality of service set forth in this chapter. Should the town find, by resolution, that the grantee has failed to maintain these technical standards and quality service, and should it, by resolution, specifically enumerate improvements to be made, the grantee may be requested to make those improvements.
